SUBJECT: First Amendment to the Advanced Funding Agreement between the City of Houston and Texas Department of Transportation (TxDOT) for the Reconstruction of Memorial Drive from North Kirkwood Rd to North Eldridge Pkwy (“Project”).
RECOMMENDATION: Approve First Amendment to the Advanced Funding Agreement between the City of Houston and Texas Department of Transportation (TxDOT).
PROJECT NOTICE/JUSTIFICATION: The Project, currently under construction, includes reconstruction of the 4-lane undivided concrete roadway with sidewalks, curbs and gutters, traffic signals, street lighting, and necessary underground utilities. Its completion will improve traffic mobility and drainage in service area.
LOCATION: The Project is located along Memorial Drive from North Kirkwood Road to North Eldridge Parkway in Key Map Grids 488 G, H and 489 E.
PREVIOUS HISTORY AND SCOPE: City Council approved Ordinance No.2011-0556 on June 29, 2011 which entered into an Advanced Funding Agreement with TxDOT to pay TxDOT for plan review costs related to the Project. City Council subsequently approved a funding agreement on October 15, 2014 under Ordinance No. 2014-0937 and appropriated additional funds to pay TxDOT for their direct project costs. The scope of services under the current agreement consists of any and all work necessary to complete the Project including construction.
SCOPE OF THIS AMENDMENT AND FEE: The requested First Amendment will reduce the City’s financial responsibility under the agreement and result in additional reimbursement of project costs by TxDOT.
Additional state funds were allocated by the Houston-Galveston Area Council’s Transportation Policy Council to the City of Houston to offset higher than anticipated costs on the Project. Under the terms of the Advance Funding Agreement the City has performed the design and construction of the Project under TxDOT oversight. This First Amendment will increase State participation in the Project and result in approximately $5.3 million of additional reimbursements from TxDOT to the City.
FISCAL NOTE: No significant Fiscal Operating Impact is anticipated as a result of this ordinance.
