Summary:

ORDINANCE consenting to the addition of 131.516 acres of land to FORT BEND COUNTY MUNICIPAL UTILITY DISTRICT NO. 168, for inclusion in the district

Background:

SUBJECT: Petition for the City’s consent to the addition of two (2) tracts of land totaling 131.516  acres to Fort Bend County Municipal Utility District No. 168.

 

RECOMMENDATION: Petition for the City’s consent to the addition of two (2) tracts of land totaling 131.516 acres to Fort Bend County Municipal Utility District No. 168 be approved.

 

SPECIFIC EXPLANATION: Fort Bend County Municipal Utility District No. 168 (the “District”) was created through the TCEQ in 2005, and currently consists of 287.6289 acres within Fort Bend County. The District is within the extraterritorial jurisdiction of the City of Houston (the “City”) and has petitioned the City for consent to add two (2) tracts of vacant land totaling 131.516 acres, proposed to be developed as single family residential and commercial property, to the District. The proposed annexation tracts are located in the vicinity of Lake Olympia Parkway, Fort Bend Tollway, Mustang Creek, and Chimney Rock Boulevard. The addition of land to the District does not release it from the City’s extraterritorial jurisdiction.

 

The Utility District Review Committee has evaluated the application with respect to wastewater collection and treatment, potable water distribution, storm water conveyance, and other public services.

 

The District does not currently have an active wastewater treatment plant. The District will provide the annexation tracts with drainage facilities and services, roads and park and recreational facilities.  The annexation tracts will be provided with wastewater treatment by Quadvest's proposed Lake Olympia Parkway Wastewater Treatment Facility. Potable water will be provided by the Quadvest.

 

The nearest major drainage facility for Fort Bend County Municipal Utility District No. 168 is Mustang Bayou.  Mustang Bayou flows into Chocolate Bay. The tracts are within the Mustang Bayou watershed. The proposed annexation tracts are partially within the 100 year floodplain (5.92%), but not within the 500 year floodplain.

 

By executing the Petition for Consent, the District has acknowledged that all plans for the construction of water conveyance, wastewater collection, and storm water collection systems within the District must be approved by the City prior to their construction.

  

The Utility District Review Committee recommends that the subject petition be approved.
