RECOMMENDATION:
Enact an ordinance approving and authorizing a pipeline easement for AMP Intrastate Pipeline, LLC (AMP) across land owned by the City of Houston, on behalf of the Houston Airport System, in Waller County, Texas.
SPECIFIC EXPLANATION:
In anticipation of a permanent pipeline easement, the City of Houston, as Grantor, and AMP, as Grantee, entered into a Temporary Right-of-Entry, Possession, and Use Agreement (TROE) with an effective date of June 18, 2019 for the purpose of allowing Grantee access to construct, operate, and maintain one (1) pipeline, up to thirty-six inches (36") in diameter, and any appurtenant facilities ("Pipeline"), for the purpose of transmitting natural gas and related by-products in, across land owned by Grantor in Waller County, Texas. It is now necessary for Grantor and Grantee to enter into a permanent pipeline easement.
The proposed easement for AMP contains the following provisions:
Easement Premises: Grantor conveys a non-exclusive fifty-foot (50') wide permanent easement, for a distance of approximately 3,100 linear feet, to conduct the aforementioned activities. Additionally, Grantor grants during the initial construction period an additional forty-foot (40') wide temporary workspace to install said Pipeline.
Payment: Grantee has paid to Grantor $35,000.00 as consideration for the easement. Payment in full was made in FY2019 when the TROE was issued.
Term: Permanent easement.
