SUBJECT: Fourth Amendment to Professional Engineering Services Contract between the City and Lockwood, Andrews & Newnam, Inc., for Surface Water Transmission Program.
RECOMMENDATION: Approve Fourth Amendment to the Professional Engineering Services Contract with Lockwood, Andrews & Newnam, Inc., and appropriate funds.
PROJECT NOTICE/JUSTIFICATION: This project is a part of the Surface Water Transmission Infrastructure Capital Improvements Program. This program is required to meet the current and future system demands and technical support to City staff on various elements of the transmission system.
DESCRIPTION/SCOPE: This project consists of various engineering services for the construction of new infrastructure and rehabilitation of existing infrastructure. New infrastructure support includes feasibility and routing studies and design for water transmission lines and appurtenances necessary to meet regulatory requirements. Rehabilitation support includes evaluating the condition and designing solutions to assist the City in extending the useful life of critical transmission lines. The net result of these efforts will improve water system reliability and operational efficiencies stemming from the consolidation of groundwater pump station facilities.

PREVIOUS HISTORY AND SCOPE: City Council approved the original Contract on March 6, 2013 under Ordinance No. 2013-0210. The scope of services under the Original Contract consisted of construction of new infrastructure and rehabilitation of existing infrastructure. Subsequent appropriations include: First Amendment on June 25, 2014 by Ordinance No. 2014-0685, a Second Amendment on July 29, 2015 by Ordinance No. 2015-0731 and the Third Amendment on November 16, 2016 by Ordinance No. 2016-0894. Various other appropriations are associated with this Professional Services Contract approved through separate Construction Awards and an Agreement.
Under this amendment, the Surface Water Transmission Program has assisted the City in reducing the groundwater pumpage and associated subsidence, meeting existing water contractual requirements providing technical assistance during transmission main outages and supporting the City’s Condition Assessment efforts.
SCOPE OF THIS AMENDMENT AND FEE: Under the scope of the Fourth Amendment, the Consultant will accomplish the following: program management (supporting the City’s management of the proposed design efforts), Phase I – Preliminary Design, Phase II – Final Design, Phase III – Construction Services and Additional Services. Basic Services fee for Phase I is based on cost of time and materials with a no-to-exceed agreed upon amount. Basic services fee for Phase II and Phase III will be negotiated on a lump sum amount after completion of Phase I. The total basic services appropriation is $1,055,000.00.
The Contract also includes certain additional services to be paid either as lump sum or on a reimbursable basis. The additional services include public meeting, surveying, geotechnical investigation, phases I and II environmental services, traffic control, surge analysis, real estate assistance and condition assessment effort. Technical support encompasses specialized engineering services required for developing technical criteria for the program, water system modeling and city planning support efforts. The total additional services, technical support and program management fee under this amendment is $1,509,000.00.
This amendment is also requesting a 5-year time extension. The extension of the Contract is requested to allow Lockwood, Andrews and Newnam, Inc., to complete design services support for all existing projects and an additional two new projects within this amendment.
The total requested appropriation is $2,820,400.00 to be appropriated as follows: $2,564,000.00 for contract services and $256,400.00 for CIP Cost Recovery.
PAY OR PLAY PROGRAM: The proposed contract requires compliance with the City’s ‘Pay or Play’ ordinance regarding health benefits for employees of City contractors. In this case, the Contractor provides health benefits to eligible employees in compliance with City policy.
M/WBE PARTICIPATION: The M/WBE goal established for this project is 24.00%. The original Contract amount and subsequent appropriations totals $52,078,682.00. The Consultant has been paid $41,997,069.00 (80.64)% to date. Of this amount, $14,502,064.31 (34.53)% has been paid to M/WBE sub-consultants to date. Assuming approval of the requested additional appropriation, the contract amount will increase to $54,642,682.00. The Consultant proposes the following plan to meet the M/WBE goal.
