Summary:

O 2020-0243 ORDINANCE appropriating $777,000.00 out of Parks & Recreation Dedication Fund, and $150,239.00 out of Contributed Capital Project Fund awarding a construction contract to LANDSCAPE ART, INC for Walter Rasmus Park; setting a deadline for the proposer's execution of the contract and delivery of all bonds, insurance and other required contract documents to the City; holding the proposer in default if it fails to meet the deadlines; providing funding for contingencies and engineering and materials testing services relating to construction of facilities financed by the Parks & Recreation Dedication Fund and the Contributed Capital Project Fund - DISTRICT J - POLLARD

Background:

RECOMMENDATION: Award construction contract and appropriate funds for the project.


SPECIFIC EXPLANATION: The General Services Department (GSD) recommends that City Council award a construction contract to Landscape Art, Inc. on the proposal amount of $828,985.00 to provide construction services for Walter Rasmus Park, for the Houston Parks and Recreation Department.

PROJECT LOCATION: 3721 Jeanetta Street, Houston, TX. 77063

PROJECT DESCRIPTION: The scope of work consists of playground demolition and replacement of playground equipment and swings for ages 2-5 and 5-12, as well as the concrete border and fall surface material. Sitework includes grading, detention, minor parking lot improvements, new walking trail and sidewalks, benches, picnic tables, and fencing, tree plantings and associated irrigation.

The contract duration for this project is 180 calendar days from the date of the Notice to Proceed.

M2L Associates Inc. is the design consultant for this project.

PROPOSALS: On July 26 and August 2, 2019, GSD advertised a Request for Competitive Sealed Proposals (CSP) for construction services for Walter Rasmus Park. The CSP contained selection criteria that ranked respondents on experience, key personnel, safety and Hire Houston First. The Statements of Qualifications were due on August 22, 2019, and eight firms responded. GSD evaluated the respondents and four of the eight firms received sufficient points and were requested to submit proposals. Three firms submitted proposals. Landscape Art, Inc. submitted the lowest proposal and offers the best value for the City based on the advertised criteria.

The three proposers are ranked as follows:

AWARD: It is recommended that City Council award the construction contract to Landscape Art, Inc., and appropriate funds for the project, including an additional appropriation of $15,355.50 for engineering and materials testing services under an existing contract with DAE & Associates, LTD dba Geotech Engineering and Testing.

M/WBE PARTICIPATION: An M/WBE goal was not established for this project because the construction cost did not exceed the $1M threshold required for a goal-oriented contract as authorized by Houston Code of Ordinances §15-82.

 

PAY OR PLAY PROGRAM: The proposed contract requires compliance with the City’s “Pay or Play” Ordinance regarding health benefits for employees of City Contractors. In this case, the contractor elects to play; providing health benefits to eligible employees in compliance with the City policy.

 

HIRE HOUSTON FIRST: The proposed contract requires compliance with the City’s “Hire Houston First” Ordinance that promotes economic opportunity for Houston businesses and supports job creation. In this case, the proposed contractor meets the requirements of Hire Houston First.

 

CIP FISCAL NOTE: No significant Fiscal Operating impact is anticipated as a result of this project.
