SUBJECT: First Amendment to Professional General Environmental, Asbestos and Lead related Consulting Services Agreement between the City and TGE Resources Inc.
RECOMMENDATION: Approve First Amendment to the Professional General Environmental, Asbestos and Lead related Consulting Services Agreement with TGE Resources Inc and appropriate funds.
PROJECT NOTICE/JUSTIFICATION: This project will provide general environmental, asbestos and lead related consulting services for environmental issues encountered on City property or in City right-of-way. Also, Federal and State regulations require the survey of multi-family, commercial and public buildings for Asbestos-Containing Materials (ACM) and Lead-Based Paint (LBP) prior to implementing renovation or demolition activities. The City uses a consultant to conduct surveys for ACM and LBP to protect the health and welfare of its citizens.
DESCRIPTION/SCOPE: This project consists of comprehensive professional environmental consulting services, asbestos and/or lead surveys for buildings, site surveys, pre-acquisition environmental site assessments, and emergency responses to any environmental issues encountered during the construction phase of City projects.
LOCATION: This agreement will encompass City projects within public right-of-way and Houston Public Works facilities at sites located throughout the City.
PREVIOUS HISTORY AND SCOPE: City Council approved the original Contract on May 11, 2016 under Ordinance No. 2016-0364. The scope of services under the Original Contract consisted of general environmental, asbestos and lead related consulting services to support the Capital Improvement Plan (CIP). The agreement was utilized on an on-call basis. Under this Contract, the Consultant performed asbestos and lead activities throughout the City.
SCOPE OF THIS AMENDMENT AND FEE: Under the scope of the First Amendment, the Consultant will accomplish the following: Continued general environmental, asbestos and lead related consulting services that support the Capital Improvement Plan (CIP) as there continues to be more on-call requests because most CIP projects require asbestos and lead investigation. The original contract expires on May 18, 2020 and has a one-year extension. The First Amendment will also extend the original contract duration an additional 2 years to May 18, 2023. Extending the contract duration prohibits funds being exhausted and delaying project timelines.
The total requested appropriation is $200,000.00.
PAY OR PLAY PROGRAM: The proposed contract requires compliance with the City’s ‘Pay or Play’ ordinance regarding health benefits for employees of City contractors. In this case, the Contractor provides health benefits to eligible employees in compliance with City policy.
M/WBE PARTICIPATION: The M/WBE goal established for this project is 24%. The original Contract amount totals $100,000.00. The Consultant has been paid $83,344.00 (83.34%) to date. Of this amount, $15,892.00 (19.07%) has been paid to M/WBE sub-consultants to date. Assuming approval of the requested additional appropriation, the contract amount will increase to $300,000.00. The Consultant proposes the following plan to meet the M/WBE goal.
