RECOMMENDATION: Award construction contract and appropriate funds for the project.
SPECIFIC EXPLANATION: The General Services Department (GSD) recommends that City Council award a construction contract to Forney Construction, LLC on the proposal amount of $1,032,228.00 to provide construction services for Hermann Park Clubhouse Civil Site Development for the Houston Parks and Recreation Department.
The renovation of the clubhouse is a Hermann Park Conservancy (HPC) approved capital project. GSD is managing the civil site development and HPC is managing the renovation of the clubhouse. Both projects are contingent on the other and were delayed because HPC did not secure funding for the clubhouse renovation until early August 2019.
PROJECT LOCATION: 6201 Hermann Park Drive, Houston, TX 77030
PROJECT DESCRIPTION: The scope of work consists of site improvements around the perimeter of the old clubhouse in Hermann Park. These improvements include site demolition of curbs and paving, new curbs, gutters, concrete drives, sidewalks, asphalt parking lots, striping/signage for parking lot, decomposed granite trails, water and sanitary lines, meters and plumbing connections and detention.
The contract duration for this project is 180 calendar days from the date of the Notice to Proceed.
MacDonald Engineering, LLC is the design consultant for this project.
PROPOSALS: On April 27 and May 4, 2018, GSD advertised a Request for Competitive Sealed Proposals (CSP) for construction services for Hermann Park Clubhouse Civil Site Development. The CSP contained selection criteria that ranked respondents on experience, key personnel, safety and Hire Houston First. Nine firms responded. GSD evaluated the respondents and two of the nine firms received sufficient points and were requested to submit proposals. Forney Construction, LLC submitted the lowest proposal and offers the best value for the City based on the advertised criteria.
Submission of proposals were delayed until HPC funding became available. Forney Construction, LLC agreed to extend its bid proposal through February 2020.

AWARD: It is recommended that City Council award the construction contract to Forney Construction, LLC, and appropriate funds for the project, including an additional appropriation of $20,000.60 for engineering and materials testing services under an existing contract with Geotech Engineering and Testing.

PAY OR PLAY PROGRAM: The proposed contract requires compliance with the City’s “Pay or Play” Ordinance regarding health benefits for employees of City contractors. In this case, the contractor elects to play; providing health benefits to eligible employees in compliance with the City policy.
HIRE HOUSTON FIRST: The proposed contract requires compliance with the City’s “Hire Houston First” (HHF) Ordinance that promotes economic opportunity for Houston businesses and supports job creation. Forney Construction, LLC is registered with the City of Houston as both a City Business and Local Business company.
CIP FISCAL NOTE: No significant Fiscal Operating impact is anticipated as a result of this project.
