SPECIFIC EXPLANATION:
Bernardo Rios, 701 East 16th Street, Houston, Texas, 77008, on behalf of Chris Evans, requested the abandonment and sale of a 10-foot-wide utility easement located within Lot 136 of the Ridgewood Addition. Bernardo Rios plans to purchase the parent tract of land from Chris Evans, the property owner, and demolish the existing structure to construct a new single family residence after passage of an ordinance abandoning the subject utility easement.
This is Part One of a two-step process in which the applicant will first receive a City Council authorized Motion acknowledging the concept of the subject request. Upon the applicant satisfactorily completing all transaction requirements including those enumerated below, the Department of Public Works and Engineering will forward a subsequent recommendation to City Council requesting passage of an Ordinance effecting the abandonment and sale. The Joint Referral Committee reviewed and approved this request subject to the conveyance of a 10-foot-wide sanitary sewer easement. Therefore, it is recommended:
1. The City abandon and sell a 10-foot-wide utility easement, in exchange for conveyance to the City of a 10-foot-wide sanitary sewer easement, both located within Lot 136 of the Ridgewood Addition;
2. The applicant be required to furnish the Department of Public Works and Engineering with a durable, reproducible (Mylar) survey plat and field notes of the affected property;
3. The applicant be required to: (a) cut, plug, and abandon the 8-inch sanitary sewer line, from the south right-of-way line of Algregg Street south to manhole #II121043 of the 8-inch sanitary sewer line in the utility easement along the south property line of Lot 136; (b) cut, plug, and abandon the 8-inch sanitary sewer line that runs along the south property line of Lot 136, from manhole #II121043 to the proposed 10-foot-wide sanitary sewer easement along the east property line; (c) construct an 8-inch sanitary sewer line in a casing pipe, from manhole #II121043 to the east property line of Lot 136 and along the east property line north to Algregg Street, then west to the existing 8-inch sanitary sewer line in Beverly Street; (d) relocate any existing service connections to the proposed 8-inch sanitary sewer line; (e) complete all of the foregoing items at no cost to the City and under the proper permits obtained through the Office of the City Engineer (OCE) and separate from any other project permits;
4. The applicant be required to prepare drawings that show all public utilities (sanitary sewer) that are to be abandoned, relocated, and/or constructed as part of this project and submit a drawing to the Office of the City Engineer for plan review and approval. A copy of the Motion shall be attached to the plan set when it is submitted for plan review;
5. The applicant be required to obtain a letter of no objection from each of the privately owned utility companies for the utility easement being abandoned and sold;
6. The Legal Department be authorized to prepare the necessary transaction documents; and
7. Inasmuch as the value of the City’s property interest is not expected to exceed $50,000.00, that the value be established by staff appraisal, according to City policy.
