SUBJECT: Second Amendment to Professional Engineering Services Contract between the City and Lockwood, Andrews & Newnam, Inc., for Highway 3 Distribution Water Line as part of the Southeast Transmission Water Line.
RECOMMENDATION: Approve Second Amendment to the Professional Engineering Services Contract with Lockwood, Andrews & Newnam, Inc., and appropriate funds.
PROJECT NOTICE/JUSTIFICATION: This project supports the execution of the Surface Water Transmission Infrastructure Capital Improvement Program. The Surface Water Transmission Program provides professional engineering services to assist the City of Houston in meeting the current and future demands and technical support to City staff on various elements of the transmission system.
DESCRIPTION/SCOPE: This amendment will fund various professional engineering services for the construction of The Highway 3 Distribution Water Line projects ranging in diameters from 8-inch to 24-inch along Highway 3 from Fuqua Street to Houston/Webster City Limit.
LOCATION: The projects are located primarily along Highway 3 from Fuqua Street to Houston/Webster City Limit.
PREVIOUS HISTORY AND SCOPE: City Council approved the original Contract on June 24, 2015 under Ordinance No. 2015-0623. The scope of services under the Original Contract provided planning engineering design services for highway 3 Distribution Water Line, Highway 3 Southeast Transmission Line and Bay Area Transmission Line, all as part of the Southeast Transmission Line. Under the original contract, the Engineer provided Phase 1 – Preliminary Engineering, limited real estate acquisition support and other associated limited additional services.
On September 26, 2018 by Ordinance No. 2018-0766 City Council approved an Amendment. Under this Amendment, the Engineer provided engineering services for the Highway 3 Distribution Line, including technical review services, real estate support, hydraulic modeling and cathodic protection.
SCOPE OF THIS AMENDMENT AND FEE: Under the scope of the Second Amendment, the Consultant will accomplish the following: tasks for the Highway 3 Distribution Line: Contract management service, construction phase service, additional real estate acquisition support, staff augmentation and coordination services. A fee of $839,200.00 is budgeted for Basic Services and $1,784,400.00 for Additional Services. The Additional Services are anticipated to include contract management service, additional real estate support and staff augmentation.
The total requested appropriation is $2,886,000.00 to be appropriated as follows: $2,623,600.00 for Contract services and $262,400.00 for CIP Cost Recovery.
PAY OR PLAY PROGRAM: The proposed contract requires compliance with the City’s ‘Pay or Play’ ordinance regarding health benefits for employees of City contractors. In this case, the Contractor provides health benefits to eligible employees in compliance with City policy.
M/WBE PARTICIPATION: The M/WBE goal established for this project is 24.00%. The original Contract amount and subsequent appropriations totals $4,578,000.00. The Consultant has been paid $1,619,764.43 (35.38%) to date. Of this amount, $365,932.43 (22.59%) has been paid to M/WBE sub-consultants to date. Assuming approval of the requested additional appropriation, the contract amount will increase to $7,201,600.00 The Consultant proposes the following plan to meet the M/WBE goal.
