SUBJECT: Additional Appropriation for Construction Management and Inspection Services Contract with Ergonomic Transportation Solutions, Inc. for Citywide Intersection Redesign and Safety Improvements Package #8.
RECOMMENDATION: (SUMMARY) Approve an ordinance appropriating additional funds to Traffic Signalization and Intersection Redesign Construction Projects contract with Ergonomic Transportation Solutions, Inc.
PROJECT NOTICE/JUSTIFICATION: This project is part of the City of Houston’s (City) Capital Improvement Plan (CIP) for Traffic Signalization and Intersection Redesign Construction projects.
DESCRIPTION/SCOPE: This project provides for Construction Management and Inspection Services associated with Street and Traffic Capital Improvement Program and consists of contract administration processing pay estimates, coordinating schedules, evaluating proposals and change orders, site representation, inspections, document control and project closeout.

PREVIOUS HISTORY AND SCOPE: City Council approved the original Construction Management and Inspection Services Contract with Ergonomic Transportation Solutions, Inc. on March 23, 2016, under Ordinance No. 2016-0225 and appropriated $40,000.00 for limited pre-construction review. Scope of services under the original contract consisted of contract administration, processing pay estimates, coordinating schedules, evaluating proposals and change orders, site representation, inspection, document control, project closeout, and other tasks requested by the Director of Houston Public Works. On June 28, 2017, under Ordinance No. 2017-0482, City Council approved an Additional Appropriation of $260,000.00 for an existing construction contract award to Traffic Signalization and Intersection Redesign Construction Projects for Traffic Capital Improvement Program through the Intersection Redesign and Safety Improvements Package #8.
SCOPE OF THIS ADDITIONAL APPROPRIATION AND FEE: The construction contractor, Jerdon Enterprise, L.P. base line schedule had to be lengthened due to the contractor delaying work and the City to procuring a right-of-way at one corner of the intersection. This delay created the need for additional Construction Management Services. The current adopted CIP has insufficient funds to meet the construction management requirements of this Agreement. The requested additional appropriation of $187,789.07 will complete payment to the construction management consultant for completion of Intersection Redesign and Safety Improvement Package #8.
PAY OR PLAY PROGRAM: The proposed contract requires compliance with the City’s ‘Pay or Play’ ordinance regarding health benefits for employees of City contractors. In this case, the contractor has elected to pay into the Contractor Responsibility Fund, in compliance with City policy.
M/WBE PARTICIPATION: The M/WBE goal established for this contract is 24%. The original contract amount and additional appropriation is $300,000.00. The consultant has been paid $260,000.00 (86.67%) to date. Of this amount, $62,400.00 (24.00%) has been paid to M/WBE sub-consultants to date. Assuming approval of the requested additional appropriation, the contract amount will increase to $487,789.07. The contractor proposes the following plan to meet the M/WBE goal.
