Summary:

O2019-0825 ORDINANCE appropriating $211,014.95 out of Metro Projects Construction DDSRF as an additional appropriation to the Construction Management and Inspection Services Agreement between the City of Houston and ERGONOMIC TRANSPORTATION SOLUTIONS, INC for Citywide Traffic Signal Rebuild Package #9 (as approved by Ordinance No. 2016-0225)

Background:

SUBJECT: Additional Appropriation for Construction Management and Inspection Services Contract with Ergonomic Transportation Solutions, Inc.

 

RECOMMENDATION: (SUMMARY) Approve an Ordinance appropriating additional funds to the Construction Management and Inspection Services Contract for Citywide Traffic Signal Rebuild Package #9 with Ergonomic Transportation Solutions, Inc.

 

PROJECT NOTICE/JUSTIFICATION: This project is part of the City of Houston’s (City) Capital Improvement Plan (CIP) for Traffic Signalization and Intersection Redesign Construction projects.

 

DESCRIPTION/SCOPE:  This Contract provides for Construction Management and Inspection Services associated with Street and Traffic Capital Improvement Program and consists of contract administration, processing pay estimates, coordinating schedules, evaluating proposals and change orders, site representation, inspection, document control and project closeout.

 

LOCATION: The project locations are in Council Districts A,B,C,F,J.

PREVIOUS HISTORY AND SCOPE: On March 23, 2016, under Ordinance No. 2016-0225, City Council approved the original Construction Management and Inspection Services Contract with Statewide Traffic Signal Company and appropriated $40,000.00 for limited pre-construction review. The scope of services under the Original Contract consisted of contract administration, processing pay estimates, coordinating schedules, evaluating proposals and change orders, site representation, inspection, document control, project closeout, and other tasks requested by the Director of Houston Public Works. On November 30, 2016, under Ordinance No. 2016-0925, City Council approved an Additional Appropriation of $450,000.00 and additional services to Traffic Capital Improvement Program through the Citywide Traffic Signal Rebuild Package #9.

 

SCOPE OF THIS ADDITIONAL APPROPRIATION AND FEE: The construction contractor, Statewide Traffic Signal Company, exceeded the time to complete the project due to an additional rebuild for traffic signals at Ley Road and Homestead. The requested additional appropriation of $211,014.95 will complete payment to the Construction Management Consultant for the additional services provided for traffic signals, curb-ramps, pavement markings and signs at Ley Road and Homestead to the Citywide Traffic Signal Rebuild Package #9 project.

 

PAY OR PLAY PROGRAM: The proposed contract requires compliance with the City’s ‘Pay or Play’ ordinance regarding health benefits for employees of City contractors. In this case, the contractor has elected to pay into the Contractor Responsibility Fund, in compliance with City policy.

 

M/WBE PARTICIPATION: The M/WBE goal established for this contract is 24%. The original contract amount and additional appropritaion is $490,000.00. The consultant has been paid $450,000.00 (91.84%) to date. Of this amount, $108,000.00 (24.00%) has been paid to M/WBE sub-consultants to date. Assuming approval of the requested additional appropriation, the contract amount will increase to $701,014.95. The contractor proposes the following plan to meet the M/WBE goal.
