SUBJECT: Approve an ordinance to execute a Second Amendment to a Sanitary Sewer Service Agreement between the City of Houston and Cy-Champ Public Utility District.
RECOMMENDATION: It is recommended that City Council adopt an Ordinance approving the Second Amendment to a Sanitary Sewer Service Agreement between the City of Houston and Cy-Champ Public Utility District.
SPECIFIC EXPLANATION: The City of Houston and Cy-Champ Public Utility District (the “District”) entered into a Sanitary Sewer Service Agreement (the “Agreement”) on October 7, 2009, by Ordinance No. 09-946 to provide for wastewater treatment and disposal of waste collection. City Council approved a First Amendment to a Sanitary Sewer Service Agreement on September 3, 2014, by Ordinance No. 14-810 so that the District could account for the addition of 40.186 acres of land to its boundaries. The First Amendment also defined the point of measurement for consistency in the Agreement.
The District has recently added 16.97 acres of land to its boundaries. This Second Amendment replaces Exhibit “A” with a new Exhibit “A” to include the additional land.
Approval of the Second Amendment to the Sanitary Sewer Service Agreement between the City of Houston and Cy-Champ Public Utility District is requested.
