Summary:

2019-0444 ORDINANCE appropriating $2,479,500.00 out of Water & Sewer System Consolidated Construction Fund, awarding contract to GRAVA LLC for Quick Connect Electrical Improvements at 50 Lift Stations; setting a deadline for the bidder’s execution of the contract and delivery of all bonds, insurance, and other required contract documents to the City; holding the bidder in default if it fails to meet the deadlines; providing funding for testing, CIP Cost Recovery, design services during construction, and contingencies relating to construction of facilities financed by the Water and Sewer System Consolidated Construction Fund - DISTRICTS A - STARDIG; B - DAVIS; C - COHEN; D - BOYKINS; E - MARTIN; H - CISNEROS; I - GALLEGOS and J - LASTER

Background:

SUBJECT: Contract Award for Quick Connect Electrical Improvements at 50 Lift Stations.

 

RECOMMENDATION:  Reject low bid, return bid bond, award Construction Contract to the second low bidder for Quick Connect Electrical Improvements at 50 Lift Stations and appropriate funds.

 

PROJECT NOTICE/JUSTIFICATION:This project is part of the Lift Station Renewal and Replacement Improvements program and is required to meet compliance with regulatory requirements.

 

DESCRIPTION/SCOPE: This project consists of electrical improvements at each lift station to provide quick connections for emergency backup power. The Contract duration for this project is 535 calendar days. This project was designed by S&B Infrastructure, Ltd.

 

LOCATION:   Districts: A, B, C, D, E, H, I and J. See attachment.

BIDS: This project was advertised for bidding on November 30, 2018. Bids were received on January 10, 2019. The three (3) bids are as follows:

AWARD: The apparent low bidder, C.F. McDonald Electric, Inc. was considered non-responsive as per the City of Houston Code of Ordinance, Sec. 15.85 due to not submitting an acceptable MWBE plan. Therefore, it is recommended that this construction contract be awarded to the second low bidder Grava, LLC, with a bid of $2,086,491.00.

 

PROJECT COST: The total cost of this project is $2,479,500.00 to be appropriated as follows:

Testing Services will be provided by JRB Engineering, LLC., under a previously approved contract.

 

HIRE HOUSTON FIRST: The proposed contract requires compliance with the City’s ‘Hire Houston First’ (HHF) ordinance that promotes economic opportunity for Houston business and supports job creation. In this case, Grava, LLC, is a designated HHF company, but they were the successful awardee without application of the HHF preference.

 

PAY OR PLAY PROGRAM: The proposed contract requires compliance with the City’s ‘Pay or Play’ ordinance regarding health benefits for employees of City contractors. In this case, the Contractor provides health benefits to eligible employees in compliance with City policy.

 

M/WSBE PARTICIPATION: The contractor has submitted the following proposed program to satisfy the 11.00% MBE goal and 7.00% WBE goal for this project.
