At approximately 2:30 a.m. on February 28, 2015, Areza Handoyo (“Plaintiff”) was a passenger in the back seat of a Mazda 3 compact car heading north on Travis Street in downtown Houston. As the driver changed lanes, a loose street storm drain grate pierced the floor of the vehicle. Mr. Handoyo claims that the drain failed as a result of defective maintenance and that the City failed warn of the danger or make the condition safe. He seeks damages in excess of $1.8 million as a result of injuries to his feet. The parties mediated the claim and have agreed to resolve the litigation.
The Legal Department recommends that Council adopt an Ordinance authorizing and approving the Compromise, Settlement and Indemnification Agreement and approve and authorize the payment of $200,000.00 out of the Property and Casualty Fund (1004) in settlement of all plaintiff’s claims.
Fiscal Note: Funding for this item is included in the FY2019 Adopted Budget. Therefore, no Fiscal Note is required as stated in the Financial Policies.
