SUBJECT: Petition for the City’s consent to the addition of three (3) tracts of land totaling 78.8285 acres to Northwest Harris County Municipal Utility District No. 5 (Key Map No. 327M & 328E & P).
RECOMMENDATION: Petition for the City’s consent to the addition of 78.8285 acres to Northwest Harris County Municipal Utility District No. 5 be approved.
SPECIFIC EXPLANATION: Northwest Harris County Municipal Utility District No. 5 (the “District”) was created through the TCEQ in 1974, and currently consists of 2,699.514 acres within Harris County. The District is within the extraterritorial jurisdiction of the City and has petitioned the City for consent to add 78.8285 acres of undeveloped land, proposed to be developed as 77% single family residential, and 23% commercial property, to the District. The proposed annexation tracts are located in the vicinity of Spring Cypress, Telge Road, Boudreaux Road, and Eldridge Parkway. The addition of land to the District does not release it from the City’s extraterritorial jurisdiction.
The Utility District Review Committee has evaluated the application with respect to wastewater collection and treatment, potable water distribution, storm water conveyance, and other public services.
The District has a wastewater collection system and treatment facility. The annexation tract will be provided with wastewater treatment by the Northwest Harris County Municipal Utility District No. 5 Wastewater Treatment No. 1. Potable water is provided by the District.
The nearest major drainage facility for the District is Faulkey Gully, which flows into Cypress Creek, then into Spring Creek then to the San Jacinto River, and finally into Lake Houston. The proposed annexation tracts are not within the 100 or 500 year floodplain.
By executing the Petition for Consent, the District has acknowledged that all plans for the construction of water conveyance, wastewater collection, and storm water collection systems within the District must be approved by the City of Houston prior to their construction.
The Utility District Review Committee recommends that the subject petition be approved.
