Summary:

RECOMMENDATION from Director Houston Public Works, reviewed and approved by the Joint Referral Committee, on request from Jason Davis of Crain, Caton & James, PC on behalf of Contanda Terminals, LLC, declining the acceptance of, rejecting, and refusing the dedication of 92nd Street, from Becker Street north ±100 feet, located within the Manchester Subdivision, out of the Callahan and Vince Surveys, A-9, Parcel SY18-050  - DISTRICT I - GALLEGOS

Background:

SUBJECT:  Request for a motion declining the acceptance of, rejecting, and refusing the dedication of 92nd Street, from Becker Street north ±100 feet, located within the Manchester Subdivision, out of the Callahan and Vince Surveys, A-9. Parcel SY18-050

 

RECOMMENDATION:  It is recommended City Council approve a motion declining the acceptance of, rejecting, and refusing the dedication of 92nd Street, from Becker Street north ±100 feet, located within the Manchester Subdivision, out of the Callahan and Vince Surveys, A-9. Parcel SY18-050

 

SPECIFIC EXPLANATION: Jason Davis of Crain, Caton & James, PC, 1401 McKinney Street, 17th Floor, Houston, Texas 77010, on behalf of Contanda Terminals, LLC, 1111 Bagby Street, Suite 1800, Houston, Texas 77002, requested the abandonment and sale of 92nd Street, from Becker Street north ±100 feet, located within the Manchester Subdivision, out of part of the Callahan and Vince Surveys, A-9.   Contanda Terminals, LLC will incorporate the requested portion of the right-of-way into its abutting property for connectivity and expansion for its existing industrial facility. Since the City never paved, installed public utilities, provided any type of maintenance, or foresees any future need for public access, the street can be considered excess to the City’s need and non-accepted as offered by the plat dedication. The Joint Referral Committee reviewed the request and determined the request could be processed as a non-acceptance.  Since the street is to be non-accepted, no property interests exist that can be sold or conveyed.  No money or other consideration will be exchanged between the City and the underlying-fee owner of the abutting property as value for any property interest.   

 

Therefore, it is recommended City Council approve a motion declining the acceptance of, rejecting, and refusing the dedication of 92nd Street, from Becker Street north   ±100 feet, located within the Manchester Subdivision, out of part of the Callahan and Vince Surveys, A-9
