SUBJECT: Second Amendment and an Additional Appropriation to the Interlocal Development Agreement for the Park Row Extension and Utility Service.
RECOMMENDATION: Approve Second Amendment and an Additional Appropriation to the Interlocal Development Agreement between the City of Houston (City) and Harris County Improvement District No. 4 (HCID No. 4) for the Park Row Extension and Utility Service with a not to exceed amount on the agreement of $5,067,966.00.
PROJECT NOTICE/JUSTIFICATION: This project is for the construction of wastewater and water lines as part of the extension of Park Row from the Interstate 10 West HOV/toll road ramp east to Eldridge Parkway.
DESCRIPTION: Under the original agreement, the City and HCID No. 4 share costs for this project. Design and construction of water and wastewater lines serving future surface water conversion and wastewater facility consolidation will be reimbursed by the City at 100%. Wastewater and water main construction costs for the new development are split 30% / 70%, similarly to agreements under the 30% Developer Participation Program. This project was split into two phases with both phases having been completed. HCID No. 4 has obtained all easements/rights-of-way for the major thoroughfare including paving, drainage, wastewater and water lines and provided all initial funding.
LOCATION: This project is located in Key Map Grids 448X, Y, 488B and C.
PREVIOUS HISTORY AND SCOPE OF THIS AGREEMENT: City Council approved the original agreement on December 12, 2012 under Ordinance 2012-1090 and appropriated $3,485,501.00. On February 3, 2016, by Ordinance 2016-0102, City Council approved the first amendment to the original agreement with an additional appropriation in the amount of $245,740.00. The City reimbursed HCID No. 4 $2,519,948.19 in 2016 for shared the costs of Phase I. The balance of funding in this agreement is $1,211,292.81. The City's shared costs of Phase II will be $2,548,017.24.
The total requested amount of $1,336,725.00 is to be appropriated to the project as follows: $1,034,596.00 for water and $302,129.00 for wastewater.
FISCAL NOTE: No significant Fiscal Operating Impact is anticipated as a result of this project.
It is recommended that City Council adopt an ordinance approving a second amendment and an additional appropriation of $1,336,725.00 into the Interlocal Agreement between the City of Houston and HCID No. 4.
