SUBJECT: Settlement of Claim of Noemi Amaya
RECOMMENDATION: (Summary)
That council adopt a Motion approving and authorizing a Settlement of the Claim of Noemi Amaya.
SPECIFIC EXPLANATION:
Noemi Amaya, the subject claimant, has filed a claim against the City of Houston for property damages occurring on August 7, 2018. The claimant alleges that an employee in the Houston Public Works Department, negligently used motor driven equipment and while clearing a sewer line, pumped sewage into the claimant's home resulting in damage.
The claimant seeks to recovery for alleged damages to her home and personal items.
Based on the lowest of three damage estimates claimant was required to obtain, I recommend this matter be settled for $71,500.00 with warrant made payable to Noemi Amaya, 7334 Shady Grove Lane, Houston, TX 77040.
Funding for this item is included in the FY19 budget for the Legal Department. Therefore, no fiscal note is required as stated in the Financial Policies.
