SUBJECT: Petition for the City’s consent to the addition of two (2) tracts of land totaling 489.21 acres to Harris County Municipal Utility District No. 449 (Key Map No. 445A, B, C, D, E, F, G & H).
RECOMMENDATION: Petition for the City’s consent to the addition of two (2) tracts of land totaling 489.21 acres to Harris County Municipal Utility District No. 449 be approved.
SPECIFIC EXPLANATION: Harris County Municipal Utility District No. 449 was created through the TCEQ in 2006, and currently consists of 736.48 acres within Harris County. The district is within the extraterritorial jurisdiction of the City and has petitioned the City for consent to add two (2) tracts of land totaling 489.21 acres of vacant land, proposed be developed as single family residential (34.06%), and commercial property (14.92%), and detention/floodplain (51.02%), to the district. The proposed annexation tracts are located in the vicinity of Clay Road, Peek Road, Stockdick School Road, and Mt. Whitney Way. The addition of land to the district does not release it from the City’s extraterritorial jurisdiction.
The Utility District Review Committee has evaluated the application with respect to wastewater collection and treatment, potable water distribution, storm water conveyance, and other public services.
The District has a wastewater collection system and treatment facility. The annexation tracts will be provided with wastewater treatment by Harris County Municipal Utility District No. 449 Wastewater Treatment Plant. Potable water is provided by the district.
The nearest major drainage facility for Harris County Municipal Utility District No. 449 is South Mayde Creek, which flows into Buffalo Bayou, and finally into the Houston Ship Channel. The proposed annexation tract is partially within 100-year floodplain (47%), and is partially within the 500-year floodplain (26%). According to the proposed land plan, development will be constructed outside the 100-year and 500-year floodplains.
By executing the Petition for Consent, the district has acknowledged that all plans for the construction of water conveyance, wastewater collection, and storm water collection systems within the district must be approved by the City of Houston prior to their construction.
The Utility District Review Committee recommends that the subject petition be approved.
