SUBJECT: Agreement to contribute funds necessary to acquire a drainage easement between the City of Houston and Harris County Flood Control District to fulfill an immediate need for drainage and conveyance of flood waters along Buffalo Bayou.
RECOMMENDATION: Adopt an ordinance approving and authorizing an Interlocal Agreement to contribute funds between the City of Houston (COH) and Harris County Flood Control District (HCFCD) and appropriate funds.
PROJECT NOTICE/JUSTIFICATION: This project is part of the Interlocal Cooperation Act (Tex.GOV'T CODE ANN., Ca. 791) by and between the City of Houston and Harris County Flood Control District. Whereas, Harris County Commissioners Court authorized HCFCD to enter into negotiations with the City of Houston for a property acquisition and joint project along Buffalo Bayou.
DESCRIPTION: This project consists of securing property for the construction of an airboat access ramp and an extreme event overland flow swale (the Property), to provide improved access to Buffalo Bayou to support continued maintenance activities and drainage and conveyance of flood waters in that area of Harris County. The City of Houston has agreed to contribute funds for acquiring a drainage easement over the Property.
LOCATION: The project area is generally bound by Briarpark Drive on the west. The project is located at 303 Briarpark Drive, also known as Lot 831, Block 31, in Briargrove Park, Section 1, a subdivision in Houston, Harris County, Texas, Key Map Grid 489R.
SCOPE OF THE AGREEMENT AND FEE: The Agreement between the COH and HCFCD entails the City's immediate need to use the Property for flood control and drainage. The COH hereby agrees to pay HCFCD $200,000.00 for contribution toward a public flood control and drainage easement over the Property within forty-five (45) days of the Effective Date of this Agreement.
The total requested amount of $220,000.00 is to be appropriated as follows: $200,000.00 for cost of the project and $20,000.00 CIP Cost Recovery.
FISCAL NOTE: No significant Fiscal Operating Impact is anticipated as a result of this project.
ACTION RECOMMENDED: It is recommended that City Council adopt an ordinance approving and authorizing an Agreement to contribute funds for an Interlocal Agreement between the City of Houston and Harris County Flood Control District and appropriate funds.
