SUBJECT: Accept Work for Safe Sidewalk Program, Work Authorization Project.

RECOMMENDATION: (SUMMARY) Pass a motion to approve the final Contract Amount of $1,917,928.09 or 1.41% over the original Contract Amount, accept the Work and authorize final payment.

PROJECT NOTICE/JUSTIFICATION: This project was part of the continuing effort of the City to construct request-based sidewalks throughout the City of Houston to meet the needs of its residents.

DESCRIPTION/SCOPE: This project provided for the construction of sidewalk improvements at various locations. Houston Public Works issued work order(s) with specific scope of work and location(s) for Contractor's execution as appropriated with 365 calendar days allowed for construction. The project was awarded to IIU-FEI Safe Sidewalk JV with an original Contract Amount of $1,891,245.50.

LOCATION: The project is located in various Key Map Grids.

CONTRACT COMPLETION AND COST: The Contractor, IIU-FEI Safe Sidewalk JV, has completed the work under the subject Contract. The project was completed beyond the established completion date with an additional 575 days approved by Change Order Nos. 1, 3, and 4. The final cost of the project, including overrun and underrun of estimated unit price quantities and previously approved Change Order No. 2 is $1,917,928.09, an increase of $26,682.59 or 1.41% over the original Contract Amount and under the 5% contingency amount. The increased cost is a result of the difference between planned and measured quantities.

M/WSBE PARTICIPATION: The advertised M/WBE contract goal for this project was 15.00%. The M/WBE plan established for this project was 15.00%. According to the Office of Business Opportunity, the participation was 14.49%. Contractor's M/WBE performance evaluation was rated Unsatisfactory. IIU-FEI Safe Sidewalk JV failed to make Good Faith Efforts to replace Chaves Services Companies, a certified WBE firm.  Contractor added two SBE firms but failed to show documentation of additional outreach to certified WBE firms to meet the goal.
