Summary:

ORDINANCE finding and determining that public convenience and necessity no longer require the continued use of a ±30-foot-wide utility easement, excluding the southeastern portion of the Frail Lane turn-around, all located in the Cannata Addition, and being out of the Jas. Berry Survey, Abstract No. 1436, Harris County, Texas, abandoning the easement to Daniel Recio, in consideration of his payment to the City of $8,634 and other good and valuable consideration - DISTRICT H - CISNEROS

Background:

SUBJECT:  Abandonment and sale of a ±30 foot-wide utility easement and the City retaining the southeastern portion of the Frail Lane turnaround, within the Cannata Addition, out of the James Berry Survey, A-1436.  Parcel SY18-044 

 

RECOMMENDATION:  It is recommended City Council approve an ordinance authorizing the abandonment and sale of a ±30 foot-wide utility easement and the City retaining the southeastern portion of the Frail Lane turnaround, within the Cannata Addition, out of the James Berry Survey, A-1436.  Parcel SY18-044 

 

SPECIFIC EXPLANATION:  John Guajardo of JAG Engineering, Inc., 9100 Southwest Freeway, Suite 130, Houston, Texas, 77074, on behalf of Daniel Recio, 638 Frail Lane, Houston, Texas, 77076, the underlying fee owner, requested the abandonment and sale of a ±30 foot-wide utility easement and the City retaining the southeastern portion of the Frail Lane turnaround, within the Cannata Addition, out of the James Berry Survey, A-1436.   The easement is void of any utilities and excess to the City’s needs.  The property owner, Daniel Recio, plans to incorporate the easement area into his abutting residential property for family use and parking

Daniel Recio has completed the transaction requirements, has accepted the City's offer, and has rendered payment in full. 

 

The City will abandon and sell to Daniel Recio:

 

Parcel SY18-044

3,524 square feet of utility easement                                  $8,634.00 (R)

Valued at $4.90 per square foot x 50%

 

TOTAL ABANDONMENT AND SALE                              $8,634.00

 

Therefore, it is recommended City Council approve an ordinance authorizing the abandonment and sale of a ±30 foot-wide utility easement and the City retaining the southeastern portion of the Frail Lane turnaround, within the Cannata Addition, out of the James Berry Survey, A-1436.
