SUBJECT: An ordinance approving and authorizing an Interlocal Agreement for Acquisition of Properties for Construction of the Northeast Transmission Line between the City of Houston and North Harris County Regional Water Authority for acquisition of rights-of-way and easements for purposes of conducting due diligence, including the performance of pre-construction testing, inspections, and assessments necessary for the construction, maintenance, and operation of a 108-inch water transmission line in connection with the Northeast Transmission Water Line Project, and for the subsequent conveyance of such real property interests to the City of Houston.
RECOMMENDATION: Adopt an ordinance approving and authorizing an Interlocal Agreement for Acquisition of Properties for Construction of the Northeast Transmission Line between the City of Houston and North Harris County Regional Water Authority for acquisition of rights-of-way and easements for purposes of conducting due diligence, including the performance of pre-construction testing, inspections, and assessments necessary for the construction, maintenance, and operation of a 108-inch water transmission line in connection with the Northeast Transmission Water Line Project, and for the subsequent conveyance of such real property interests to the City of Houston.
SPECIFIC EXPLANATION:
The City of Houston (the “City”) is preparing to construct the Northeast Transmission Water Line Project (the “Project”) which will be located within the service area of the North Harris County Regional Water Authority (the Authority). The Authority and the City desire to work together to facilitate the construction of the Project by entering into an Interlocal Agreement giving both the Authority and the City various rights to perform pre-construction activities including soil testing and land acquisition as needed for the Project.
The Project will convey treated water from surface water facilities owned by the City to the Authority and others and is necessary in order for the Parties to comply with their respective obligations under the Harris-Galveston Subsidence District's rules and regulation and to assist the City in meeting future system demands of its transmission system.
LOCATION: The Projects are located at or near the intersection of Beltway 8 and Hardy Toll Road.
SCOPE OF THE AGREEMENT: The agreement between the City of Houston and the Authority provides that the Authority will access and acquire the properties necessary for the Projects by donation, purchase, or exercise of their eminent domain authority for rights-of-way, easements, and other property interests necessary for the construction, installation, operation, and maintenance of the Projects. Additionally, the agreement entails performance of pre-construction testing, inspections, and assessments required to facilitate design and engineering work for the Projects.
