SUBJECT: First Amendment to Professional Engineering Services Contract between the City and CivilTech Engineering, Inc. for Memorial Drive Paving and Drainage Improvements from North Kirkwood Road to North Eldridge Parkway.
RECOMMENDATION: (SUMMARY) Approve First Amendment to the Professional Engineering Services Contract with CivilTech Engineering, Inc. and appropriate funds.
PROJECT NOTICE/JUSTIFICATION: This project is part of the Street and Traffic Capital Improvement Plan (CIP) program. This program is required to meet City of Houston standards, improve traffic mobility and storm drainage.
DESCRIPTION/SCOPE: This project consists of the design of approximately 11,000 linear feet of roadway widening to major thoroughfare standards. The proposed project improvements include a four-lane divided concrete roadway with medians, continuous bike lane, sidewalks, curbs, improved intersections with turn lanes, improved drainage storm sewer system, traffic signals, street lighting and necessary underground utilities.
LOCATION: The project area is generally bound by IH-10 on the north, Briarforest on the south, North Kirkwood on the east and North Eldridge Parkway on the west. The project is located in Key Map Grids 488G, 488H and 489E.
PREVIOUS HISTORY AND SCOPE: City Council approved the original Contract on December 16, 2009 under Ordinance No. 2009-1332, first Additional Appropriation on July 25, 2012 under Ordinance No. 2012-0659, and a second Additional Appropriation on December 10, 2014 under Ordinance No. 2014-1332. The scope of services under the Original Contract consisted of Basic Services Fee for Phase I – Preliminary Design, Phase II – Final Design, Phase III – Construction Phase services and various additional services. Under this Contract, the Consultant completed 100% for Phase I, 100% for Phase II, 50% Phase III, and various additional services.
SCOPE OF THIS AMENDMENT AND FEE: Under the scope of the First Amendment, the Engineer will accomplish the following: Phase III Basic Services and certain Phase II Additional Services. A fee of $145,600.00 is budgeted for Basic Services and $51,770.00 for Additional Services. The Additional Services are anticipated to include Median Modifications and Technical Coordination. The requested amendment to the contract is to update the Exhibit D – Raw Salary Rates.
The total requested appropriation is $230,923.00 to be appropriated as follows: $197,370.00 for contract services and $33,553.00 for CIP Cost Recovery.
PAY OR PLAY PROGRAM: The proposed contract requires compliance with the City’s ‘Pay or Play’ ordinance regarding health benefits for employees of City contractors. In this case, the Contractor provides health benefits to eligible employees in compliance with City policy.
M/WBE PARTICIPATION: The M/WBE goal established for this project is 24.0%. The original Contract amount and subsequent appropriations total $2,596,874.53. The Consultant has been paid $2,372,424.00 (91.36%) to date. Of this amount, $880,833.60 (37.13%) has been paid to M/WBE sub-consultants to date. Assuming approval of the requested additional appropriation, the contract amount will increase to $2,794,244.53. The Consultant proposes the following plan to meet the M/WBE goal.
