Summary:

ORDINANCE consenting to the addition of 26.127 acres of land to CHIMNEY HILL MUNICIPAL UTILITY DISTRICT, for inclusion in its district

Background:

SUBJECT: Petition for the City’s consent to the addition of 26.127 acres to Chimney Hill Municipal Utility District  (Key Map No. 408R & 408V).

RECOMMENDATION: Petition for the City’s consent to the addition of 26.127 acres to Chimney Hill Municipal Utility District be approved.

SPECIFIC EXPLANATION: Chimney Hill Municipal Utility District  was created through the TCEQ  in 1976, and currently consists of 569.037 acres within Harris County. The district is within the extraterritorial jurisdiction of the City and has petitioned the City for consent to add 26.127 acres of developed commercial property, to the district. The proposed annexation tract is located in the vicinity of Emmett Road, Horsepen Creek, Weiman Road, and N. Eldridge Parkway. The addition of land to the district does not release it from the City’s extraterritorial jurisdiction.

The Utility District Review Committee has evaluated the application with respect to wastewater collection and treatment, potable water distribution, storm water conveyance, and other public services.

The District has a wastewater collection system and treatment facility. The annexation tract will be provided with wastewater treatment by the Chimney Hill Wastewater Treatment Facility. Potable water is provided by the district.

The nearest major drainage facility for Chimney Hill Municipal Utility District  is Horsepen Creek, which flows to Langham Creek, then to South Mayde Creek, then to Buffalo Bayou, and finally into the Houston Ship Channel. The proposed annexation tract is not within the 100-year floodplain or 500-year floodplain.

By executing the Petition for Consent, the district has acknowledged that all plans for the construction of water conveyance, wastewater collection, and storm water collection systems within the district must be approved by the City of Houston prior to their construction.

The Utility District Review Committee recommends that the subject petition be approved.
