SUBJECT: Adopt an Ordinance approving Additional Appropriation for Change Order No. 5 for East Water Purification Plant Rehabilitation of Flocculators, Clarifiers, and Thickeners.
RECOMMENDATION: (SUMMARY) Adopt an Ordinance approving Additional Appropriation of $418,600.00 for East Water Purification Plant Rehabilitation of Flocculators, Clarifiers, and Thickeners.
PROJECT NOTICE/JUSTIFICATION: This project is part of the City’s Capital Improvement Program to increase the safety, reliability and the efficiency of operations at the East Water Purification Plant.
DESCRIPTION/SCOPE: The project included the replacement or repairs of primary drives and sludge raking mechanisms for the sedimentation, thickener and surge basins. It also included flocculator recoating and component repairs, basin floor slab repairs, basin wall cracks and expansion joint repairs. The Project was awarded to PLW Waterworks, LLC (formerly Pepper-Lawson Construction, L.P.) with an original Contract Amount of $6,634,000.00.
LOCATION: The project area is located at 2300 Federal Road in Key Map Grids 496 U and Y.
ADDITIONAL APPROPRIATION: An Approval is requested for an additional appropriation of $363,983.95 in excess of the original contract value and extension of 867 days of contract time for additional work described in Change Order No. 5 to repair rake arms and corner sweeps in Basin A, to remove and replace corner sweep guide plates, and to repair basin floor and expansion joints in Basin E. This scope of work is necessary to complete the execution of this project due to inspection results.
The requested appropriation will cover the additional work identified and leave the 5% contingencies balance for the completion of the remaining contract work.
The total requested appropriation is $418,600.00 to be appropriated as follows: $363,983.95 for contract services and $54,616.05 for CIP Cost Recovery.
PAY OR PLAY PROGRAM: The proposed contract requires compliance with the City’s ‘Pay or Play’ ordinance regarding health benefits for employees of City contractors. In this case, the Contractor provides benefits for some employees but will pay into the Contractor Responsibility Fund for others, in compliance with City policy.
MWBE/SBE PARTICIPATION: The M/SBE goal established for this contract is 18%. The original Contract approved by Ordinance No. 2011-0528 is in the amount of $6,634,000.00. Assuming approval of Change Order No. 5, the Contract amount will increase to $6,997,983.95. According to Office of Business Opportunity, the Contractor's to date MWBE/SBE performance is 22.86%.
FISCAL NOTE: No significant Fiscal Operating impact is anticipated as a result of this project.
