Summary:

ORDINANCE consenting to the creation of FORT BEND COUNTY MUNICIPAL UTILITY DISTRICT NO. 229, containing 437.6585 acres of land within the extraterritorial jurisdiction of the City of Houston, Texas; authorizing the district to exercise road powers and to issue bonds for road facilities

Background:

 

SUBJECT: Petition for the City’s consent to the creation of 437.6585 acres as Fort Bend County Municipal Utility District No. 229 (Key Map No. 524 J, K, N, & P).  

 

RECOMMENDATION: Petition for the City’s consent to the creation of 437.6585 acres as Fort Bend County Municipal Utility District No. 229 be approved. 

SPECIFIC EXPLANATION: The owners of 437.6585 acres of land, located within Fort Bend County and within the extraterritorial jurisdiction of the City, have petitioned the City for consent to create a district.  The previous development has been removed and the site is proposed to be developed as single family, multi-family, and commercial property. The proposed district is located in the vicinity of Settegast Ranch Road, F.M. 359, Fulshear Gaston Road, and West Hidden Lake Lane. The creation of the district does not release it from the City’s extraterritorial jurisdiction.

The Utility District Review Committee has evaluated the application with respect to wastewater collection and treatment, potable water distribution, storm water conveyance, and other public services.

The District will have a wastewater collection system and treatment facility. Potable water will be provided by the district.

The nearest major drainage facility for proposed Fort Bend County Municipal Utility District No. 229 is Flewellen Creek which flows to the Brazos River and finally into the Gulf of Mexico. The proposed annexation tract is partially within the 100 year floodplain (6.7%) and the 500 year floodplain (1.5%). 

By executing the Petition for Consent, the district has acknowledged that all plans for the construction of water conveyance, wastewater collection, and storm water collection systems within the district must be approved by the City of Houston prior to their construction.   

 

The Utility District Review Committee recommends that the subject petition be approved.
