Summary:

ORDINANCE consenting to the addition of 0.6267 acre of land to FORT BEND COUNTY MUNICIPAL UTILITY DISTRICT NO. 58, for inclusion in its district

Background:

SUBJECT: Petition for the City’s consent to the addition of 0.6267 acres to Fort Bend County Municipal Utility District No. 58 (Key Map No. 484N).

RECOMMENDATION: Petition for the City’s consent to the addition of 0.6267 acres to Fort Bend County Municipal Utility District No. 58 be approved.

SPECIFIC EXPLANATION: Fort Bend County Municipal Utility District No. 58 was created through the TCEQ in 1984, and currently consists of 1,377.3753 acres within Fort Bend County. The district is within the extraterritorial jurisdiction of the City and has petitioned the City for consent to add 0.6267 acres of abandoned, undeveloped public right-of-way that has been deeded to the property owner/developer.  This land will become part of the abutting single family residential lots that already reside within the district.  The proposed annexation tract is located in the vicinity of Cinco Trace Dr., FM 1463, Crossover Road, and Katy-Flewellen Road. The addition of land to the district does not release it from the City’s extraterritorial jurisdiction.

The Utility District Review Committee has evaluated the application with respect to wastewater collection and treatment, potable water distribution, storm water conveyance, and other public services.

The District has a wastewater collection system and treatment facility. The annexation tract will be provided with wastewater treatment by the Fort Bend County MUD No. 58 Treatment Facility. Potable water is provided by the district. 

The nearest major drainage facility for Fort Bend County Municipal Utility District No. 58 is Buffalo Bayou, which flows into the Houston Ship Channel. The proposed annexation tract is not within the 100-year floodplain and is not  within the 500-year floodplain.

By executing the Petition for Consent, the district has acknowledged that all plans for the construction of water conveyance, wastewater collection, and storm water collection systems within the district must be approved by the City of Houston prior to their construction.

The Utility District Review Committee recommends that the subject petition be approved.
