SUBJECT: First Amendment to Professional Engineering Services Contract between the City and Aguirre & Fields, LP for Work Order Bridge Rehabilitation/Replacement Program.
RECOMMENDATION: (SUMMARY) Approve First Amendment to the Professional Engineering Services Contract with Aguirre & Fields, LP and appropriate funds.
PROJECT NOTICE/JUSTIFICATION: This project is part of the Street and Traffic Capital Improvement Plan and is required to provide professional engineering services to address local bridge structure repairs/rehabilitation design citywide.
DESCRIPTION/SCOPE: This project consists of evaluation of existing bridges which were nominated due to safety conditions or substandard inspection ratings as well as preparation of design plans to rehabilitate or replace the bridge/roadway structures throughout the City.

PREVIOUS HISTORY AND SCOPE: City Council approved the original Contract on February 18, 2015 under Ordinance No. 2015-0142, an additional appropriation on November 4, 2015 under Ordinance No. 2015-1079 and subsequent additional appropriation on August 30, 2017 under Ordinance No. 2017-0675. The previous project assignments included completion of Phase II and Phase III services of Buffalo Speedway Bridge Grade Separation over Holmes Road and final rehabilitation Phase II design for bridges at 3200 Brazos Bridge over Smith Street, 6500 Tidwell Road Bridge and 9300 Braes Bayou Drive Bridge.
SCOPE OF THIS FIRST AMENDMENT AND FEE: This First Amendment will add four (4) years to the contract terms and the scope of services will remain unchanged. The extension will allow the consultant to perform required engineering work to support the bridge rehabilitation and replacement needs of the City, including an emergency repair of West Lake Houston Bridge damage caused by Hurricane Harvey.
The total requested appropriation is $600,000.00 to be appropriated as follows: $500,000.00 for contract services and $100,000.00 for CIP Cost Recovery.
PAY OR PLAY PROGRAM: The proposed contract requires compliance with the City’s ‘Pay or Play’ ordinance regarding health benefits for employees of City contractors. In this case, the Contractor provides health benefits to eligible employees in compliance with City policy.
M/WBE PARTICIPATION: The M/WBE goal established for this project is 24%. The original Contract amount and subsequent appropriations total $850,000.00. The Consultant has been paid $448,954.23 (52.82%) to date. Of this amount, $137,039.50 (30.52%) has been paid to M/WBE sub-consultants to date. Assuming approval of the requested additional appropriation, the contract amount will increase to $1,350,000.00. The Consultant proposes the following plan to meet the M/WBE goal.
