Background:

SUBJECT: Petition for the City’s consent to the addition of three tracts of land totaling 122.9990 acres to Northwest Harris County Municipal Utility District No. 10 (Key Map No. 327 Q and 367 C).

 

RECOMMENDATION: Petition for the City’s consent to the addition of three tracts of land totaling 122.9990 acres to Northwest Harris County Municipal Utility District No. 10 be approved.

 

SPECIFIC EXPLANATION: Northwest Harris County Municipal Utility District No. 10 was created through the TCEQ in 1977, and currently consists of 1,163.5548 acres within Harris County. The district is within the extraterritorial jurisdiction of the City and has petitioned the City for consent to add three tracts of vacant land (tracts 14, 15, and 16) totaling 122.9990 acres to the district.  Annexation tract 14 (5.348 acres) is proposed be developed as three commercial buildings, and annexation tracts 15 and 16 (84.520 and 33.131 acres respectively) are currently owned by the district and are part of a nature park that will remain undeveloped.  The proposed annexation tracts are located in the vicinity of Spring Cypress Road, Skinner Road, Grant Road, and Telge Road. The addition of land to the district will not release it from the City’s extraterritorial jurisdiction.

 

The Utility District Review Committee has evaluated the application with respect to wastewater collection and treatment, potable water distribution, storm water conveyance, and other public services.

 

The District has a wastewater collection system and treatment facility. The annexation tracts will be provided with wastewater treatment by the Northwest Harris County Municipal Utility District No. 10 Wastewater Treatment Plant. Potable water will be provided by the district.

 

The nearest major drainage facility for Northwest Harris County Municipal Utility District No. 10 is Little Cypress Creek, which flows into Cypress Creek, then to Spring Creek, then to the San Jacinto River, and finally into Lake Houston.  Annexation tract 14 (5.348 acres) is within the 100 year floodplain, but the developer plans to elevate the non-detention pond area above the 100 year floodplain and will develop the buildings above the 500 year floodplain.  Annexation tracts 15 and 16 (84.520 and 33.131 acres respectively) are park land located within the floodway and will remain undeveloped. 

 

By executing the Petition for Consent, the district has acknowledged that all plans for the construction of water conveyance, wastewater collection, and storm water collection systems within the district must be approved by the City of Houston prior to their construction.

 

The Utility District Review Committee recommends that the subject petition be approved.
