SUBJECT: Agreement to Contribute Right of Way Funds (Fixed Price) between the City of Houston and Texas Department of Transportation (TxDOT) for improvements to FM 525 from Lee Road to US 59.
RECOMMENDATION: De-appropriate funds from the previous agreement, adopt an ordinance approving and authorizing an Agreement to Contribute Right of Way Funds (Fixed Price) between the City of Houston and TxDOT and appropriate funds.
PROJECT NOTICE/JUSTIFICATION: Texas Transportation Code 201.209 authorizes the State and Local Government to enter into Agreements. TxDOT has deemed it necessary to make certain highway improvements to FM 525. This section of highway improvements will necessitate the acquisition of certain right of way.
DESCRIPTION: This agreement is for the acquisition of additional right-of-way needed to widen FM 525 from Lee Road to US 59, to six lanes with a continuous left turn lane.
LOCATION: FM 525 from Lee Road to US 59 located in Key Map Grids 374Z and 375W.
SCOPE OF THE AGREEMENT AND FEE: City Council previously approved an Agreement for Right of Way Procurement under Ordinance No. 2018-0088 on February 7, 2018 appropriating funds in the amount of $14,538.50. However, TxDOT recently notified the City that the agreement was not prepared correctly and provided a new Agreement to Contribute Right of Way Funds (Fixed Price). The original agreement will be superseded upon execution of the new agreement. The funds previously appropriated will be de-appropriated and appropriated for the new agreement.
FISCAL NOTE: No significant Fiscal Operating Impact is anticipated as a result of this project.
ACTION RECOMMENDED: It is recommended that City Council adopt an ordinance approving and authorizing an agreement to contribute Right of Way Funds (Fixed Price) between the City of Houston and TxDOT.
