Summary:

ORDINANCE appropriating $50,494.63 out of Water & Sewer System Consolidated Construction Fund as an additional appropriation to Construction Management and Inspection Services Contract between the City of Houston and LLOYD, SMITHA & ASSOCIATES, LLC for the 24-inch water line along West Bellfort from Buffalo Speedway to Stella Link (Approved by Ordinance No. 2015-0143) - DISTRICT K - CASTEX-TATUM

Background:

SUBJECT: Additional Appropriation for Construction Management and Inspection Services Contract between the City of Houston and Lloyd, Smitha & Associates, LLC associated with a Contract Award for 24-inch Water Line along West Bellfort from Buffalo Speedway to Stella Link.

 

RECOMMENDATION: (SUMMARY) Approve an ordinance appropriating additional funds to the Construction Management and Inspection Services Contract with Lloyd, Smitha & Associates, LLC.

 

PROJECT NOTICE/JUSTIFICATION: This project is part of the Capital Improvement Plan and is necessary to construct transmission and distribution lines to convey treated water from surface water facilities.

 

DESCRIPTION/SCOPE: This Contract provides for Construction Management and Inspection Services for Capital Projects in connection with water and wastewater projects.

 

LOCATION: The project is located at West Bellfort, from Stella Link to Buffalo Speedway, Key Map Grids 532 S and 532 T.

 

PREVIOUS HISTORY AND SCOPE: The City Council approved the original Construction Management and Inspection Services Contract with Lloyd, Smitha & Associates, LLC on February 18, 2015 under Ordinance No. 2015-0143 and appropriated $40,000.00 for limited pre-construction review. The following work authorizations have been issued under this contract.

SCOPE OF THIS ADDITIONAL APPROPRIATION AND FEE: This contract was referenced in Ordinance No. 2015-0577, passed on June 17, 2015 to perform Construction Management and Inspection services for the 24-inch Water Line along West Bellfort from Buffalo Speedway to Stella Link project. The construction contractor, E.P. Brady, Ltd., exceeded the time to complete the project due to utility conflicts. Under this Contract, the consultant required additional funds to complete performing Construction Management and Inspection services.

 

The requested appropriation of $50,494.63 completes payment to the Consultant for the additional services provided for the 24-inch Water Line along West Bellfort from Buffalo Speedway to Stella Link project.

 

PAY OR PLAY PROGRAM: The proposed contract requires compliance with the City’s ‘Pay or Play’ ordinance regarding health benefits for employees of City contractors. In this case, the Contractor has elected to pay into the Contractor Responsibility Fund in compliance with City policy.

 

M/WBE PARTICIPATION: The M/WBE goal established for this contract is 24%. The current total appropriation for this Construction Management Contract is $765,000.00. The consultant has been paid $668,565.42 (87.39%) to date. Of this amount, $167,746.96 (25.09%) has been paid to M/WBE sub-consultants to date.

 

FISCAL NOTE: No significant Fiscal Operating impact is anticipated as a result of this project.
