Summary:

ORDINANCE appropriating $739,050.00 out of the Water & Sewer System Consolidated Construction Fund as an additional appropriation to Professional Engineering Services Contract between the City of Houston and BINKLEY & BARFIELD, INC for the 69th Street Wastewater Treatment Plant Improvements Packages 5 and 6 (as approved by Ordinance No. 2011-0759); providing funding for CIP Cost Recovery relating to construction of facilities financed by the Water & Sewer System Consolidated Construction Fund - DISTRICT H - CISNEROS

Background:

SUBJECT: Additional Appropriation to Professional Engineering Services Contract between the City and Binkley & Barfield, Inc. for 69th Street Wastewater Treatment Plant Improvements Packages 5 and 6.

 

RECOMMENDATION: Approve an ordinance appropriating additional funds to the Professional Engineering Services Contract with Binkley & Barfield, Inc..

 

PROJECT NOTICE/JUSTIFICATION: This project is part of the City’s program to renew/replace inefficient components of the existing wastewater treatment plant facilities.

 

DESCRIPTION/SCOPE: This project consists of the removal of the existing Automatic Back Washing sand filter systems and modifications of the existing infrastructures and electrical system for the installation of the new Kruger Disc Filter System.

 

LOCATION: The project area is located at 2525 S. Sgt. Macario Garcia Drive in Key Map Grid is 494R.

 

PREVIOUS HISTORY AND SCOPE: City Council approved the original Contract on August 31, 2011 under Ordinance No. 2011-0795. The scope of services under the Original Contract consisted of: (1) Evaluate the field instruments and control system including wiring throughout the facility and provide improvements. (2) Rehabilitation of O2 plant cold box B. The original contract consisted of Basic Services (Phase I, II and III) and various Additional Services for Package 1 and part of Package 2. Under this Contract, the Consultant completed Phases I, II and III for Package 1 along with Phase I for Package 2.

 

The Technical Review Committee voted on May 1, 2013 to procure Kruger Disc Filter System before proceeding with Phase II and III design services. Phase I analysis did not perform preliminary engineering investigation for the existing Automatic Back Washing basin structure or electrical modifications due to uncertainty of the filter system selection.

 

Due to added scope of work to this project, additional funds are needed for Phase II and Phase III Basic and Additional design services.

 

SCOPE OF THIS ADDITIONAL APPROPRIATION AND FEE: The requested additional appropriation will accomplish the following tasks: Additional cost of $319,177.00 for Phase II-Final Design and $191,659.00 for Phase III – Construction Phase Services. A fee of $510,836.00 is budgeted for Basic Services and $80,398.00 for Additional Services. The Additional Services are anticipated to include Phase II – Electrical Short Circuit Studies and Report, Texas Commission for Environmental Quality Permitting Submittal, Reproduction and Other Additional Services which comprise the bulk of the funds.

 

The total requested appropriation is $739,050.00 to be appropriated as follows: $591,234.00 for contract services and $147,816.00 for CIP Cost Recovery.

 

PAY OR PLAY: The proposed contract requires compliance with the City’s ‘Pay or Play’ ordinance regarding health benefits for employees of City contractors. In this case, the Contractor provides health benefits to eligible employees in compliance with City policy.

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

M/WBE PARTICIPATION: The M/WBE goal established for this project is 24.00%. The original Contract amount totals $2,174,281.00. The Consultant has been paid $1,273,946.61 (58.59%) to date. Of this amount, $345,573.25 (27.13%) has been paid to M/WBE sub-consultants to date. Assuming approval of the requested additional appropriation, the contract amount will increase to $2,765,515.00. The Consultant proposes the following plan to meet the M/WBE goal.
