Summary:

ORDINANCE finding and determining that public convenience and necessity no longer require the continued use of: (1) a 3 foot-wide sanitary sewer easement, located in Lots 28, 29, and 30 of Colby Court; (2) a 5 foot-wide utility easement, located in Lots 28, 29, and 30 of Colby Court; and (3) a 5 foot-wide utility easement, located in Lots 42 and 43 of Colby Court, all out of the Obediance Smith Survey, Abstract No. 696, Harris County, Texas; abandoning the easements to the First Presbyterian Church of Houston, the abutting owner, in consideration of its conveyance to the City of a 25 foot-wide sanitary sewer easement, payment to the City of $300.00 and other consideration - DISTRICT C - COHEN

Background:

SUBJECTOrdinance authorizing the abandonment and sale of: 1) a 3 foot-wide sanitary sewer easement in Lots 28, 29, and 30; 2) a 5 foot-wide utility easement in Lots 28, 29, and 30; and 3) a 5 foot-wide utility easement in Lots 42 and 43, in exchange for conveyance to the City of a 25 foot-wide sanitary sewer easement, all located within the Colby Court Addition, out of the Obediance Smith Survey, A-696. Parcels SY17-043A, SY17-043B, SY17-043C, and DY18-008

RECOMMENDATION: (Summary) It is recommended City Council approve an ordinance authorizing the abandonment and sale of: 1) a 3 foot-wide sanitary sewer easement in Lots 28, 29, and 30; 2) a 5 foot-wide utility easement in Lots 28, 29, and 30; and 3) a 5 foot-wide utility easement in Lots 42 and 43, in exchange for conveyance to the City of a 25 foot-wide sanitary sewer easement, all located within the Colby Court Addition, out of the Obediance Smith Survey, A-696. Parcels SY17-043A, SY17-043B, SY17-043C, and DY18-008

SPECIFIC EXPLANATION:  Robert Kness, Windrose Land Service, 3200 Wilcrest Drive, Suite 325 Houston, Texas 77042, on behalf of The First Presbyterian Church, (Jerry Ballard, Executive Director), requested the abandonment and sale of: 1) a 3 foot-wide sanitary sewer easement in Lots 28, 29, and 30; 2) a 5 foot-wide utility easement in Lots 28, 29, and 30; and 3) a 5 foot-wide utility easement in Lots 42 and 43, all located within the Colby Court Addition, out of the Obediance Smith Survey, A-696.  The First Presbyterian Church plans to construct a church building and parking lot in the location of the existing easements.  The Joint Referral Committee reviewed and approved this request subject to the conveyance to the City of a 25 foot-wide sanitary sewer easement.

The First Presbyterian Church has complied with the transaction requirements and has accepted the City’s offer.

TOTAL ABANDONMENT AND SALE                  $102,000.00
 
In exchange, The First Presbyterian Church will pay:   
 
Cash $300.00
 
Plus convey to the City:  
 
Parcel DY18-008      
3,100 square-foot sanitary sewer easement:   $186,000.00  
Valued at $120.00 PSF X 50%      
       
TOTAL CASH AND CONVEYANCE   $186,300.00  

 

Inasmuch as the value of the $300.00 minimum parcel fee plus the sanitary sewer easement being conveyed to the City is greater than the value of the easements being abandoned and sold, it is recommended City Council approve an Ordinance authorizing the abandonment and sale of:  1) a 3 foot-wide sanitary sewer easement in Lots 28, 29, and 30; 2) a 5 foot-wide utility easement in Lots 28, 29, and 30; and 3) a 5 foot-wide utility easement in Lots 42 and 43, in exchange for conveyance to the City of a 25 foot-wide sanitary sewer easement, all located within the Colby Court Addition, out of the Obediance Smith Survey, A-696
