SUBJECT: Additional Appropriation to the Professional Engineering Services Contract between the City and Stantec Consulting Services, Inc. for Hirsch Road Paving and Drainage.
RECOMMENDATION: (SUMMARY) Approve an ordinance appropriating additional funds to the Professional Engineering Services Contract with Stantec Consulting Services, Inc.
PROJECT NOTICE/JUSTIFICATION: This project is part of the Capital Improvement Plan (CIP). This program is required to meet City of Houston standards as well as improve traffic circulation, mobility and drainage in the service area.
DESCRIPTION/SCOPE: This project consists of the roadway reconstruction of approximately 4,800 linear feet of the existing half boulevard section (2 lanes) on Hirsh Road from Crosstimbers to Laura Koppe. The proposed improvements will consist of right of way acquisition for future expansion per Major Thoroughfare Freeway Plan (MTFP) standards, concrete roadways, curb, sidewalks, and underground utilities as required.
LOCATION: The project area is generally bound by Laura Koppe on the north and Crosstimbers on the south. The project is located in Key Map Grids 454F and 454K.
PREVIOUS HISTORY AND SCOPE: City Council approved the original Contract on 04-08-2015 under Ordinance No. 2015-0299. The scope of the services under the original contract consisted of reconstruction of Hirsch Road from Crosstimbers to Laura Koppe which required taking property from the cemetery. Under the original Contract the consultant completed phase I preliminary design and 60% of the final design. Review of the real estate documents by Real Estate Legal Group for taking property from the cemetery, as per original plan (Preliminary Engineering Report) raised concerns about absence of power of Emanate Domain on cemeteries, and consequent difficulty of acquisition. Therefore, it was suggested not to consider acquiring property from the cemetery. Additional design funds are required to realign the roadway center line to avoid taking property from the cemetery.
SCOPE OF THIS AMENDMENT AND FEE: The requested additional appropriation will accomplish the following tasks: completion of the Phase II Final Design and Phase III Construction Services. A fee of $17,817.00 is budgeted for Basic Services and $110,963.00 for Additional Services Fee.
The total requested appropriation is $150,672.60 to be appropriated as follows: $128,780.00 for contract services and $21,892.60 for CIP Cost Recovery.
PAY OR PLAY PROGRAM: The proposed contract requires compliance with the City’s ‘Pay or Play’ ordinance regarding health benefits for employees of City contractors. In this case, the Consultant provides benefits to eligible employees in compliance with City policy.
M/WBE PARTICIPATION: The M/WBE goal established for this project is 24%. The original Contract amount totals $839,900.00. The Consultant has been paid $691,649.49 (82.35%) to date. Of this amount, $166,586.24 (24.09%) has been paid to M/WBE sub-consultants to date. Assuming approval of the requested additional appropriation, the contract amount will increase to $968,680.00. The Consultant proposes the following plan to meet the M/WBE goal:
