SUBJECT: Second Additional Appropriation for Construction Management and Inspection Services Contract between the City of Houston and Weston Solutions, Inc. associated with a Contract Award for the Northside Sewer Relief Tunnel Rehabilitation Area No. 4.
RECOMMENDATION: Approve an Ordinance appropriating additional funds to the Construction Management and Inspection Services Contract with Weston Solutions, Inc.
PROJECT NOTICE/JUSTIFICATION: This contract is to provide construction management and inspection services for CIP sanitary sewer projects within the City limit.
DESCRIPTION/SCOPE: This Contract provides Construction Management and Inspection Services for Capital Projects in connection with sanitary sewer services.
LOCATION: The project area is generally bound by IH-10 on the north, Buffalo Bayou on the south, Bayou Road on the east, and Elysian St. on the west. The project area is located in Key Map Grids 493M & 494J.
PREVIOUS HISTORY AND SCOPE: The City Council approved the original Construction Management and Inspection Services Contract with Weston Solutions, Inc. on June 1, 2011 under Ordinance No. 2011-0411, appropriating $12,000.00 for limited pre-construction review. The following work authorizations have been issued under this contract.

|
SCOPE OF THIS ADDITIONAL APPROPRIATION AND FEE: This contract was referenced in Ordinance No. 2012-0582, passed on June 20, 2012, to perform Construction Management and Inspection Services for Northside Sewer Relief Tunnel Rehabilitation Area No. 4. Under this Contract, the consultant, Weston Solutions, Inc., required additional funds to compensate their additional Construction Management and Inspection services due to the following reasons:

The actual contractual construction duration exceeded 100 days more than the negotiated duration.

The construction contractor, Oscar Renda Contracting, Inc., exceeded the time to complete the project by 412 days of the original contract time.
- The efforts Weston Solutions expended to assist the City with resolution of by-pass pumping issue before Oscar Renda Contracting, Inc. contract NTP date.
The requested appropriation of $319,556.58 will complete the Construction Management and Inspection Services for the Northside Sewer Relief Tunnel Rehabilitation Area # 4 project.
PAY OR PLAY PROGRAM: The proposed contract requires compliance with the City’s ‘Pay or Play’ ordinance regarding health benefits for employees of City contractors. In this case, the Contractor provides health benefits to eligible employees in compliance with City policy.
M/WBE PARTICIPATION: The M/WBE goal established for this contract is 24%. The current total appropriation for this Construction Management contract is $1,937,000.00 The consultant has been paid $1,759,799.00 (90.86%) to date. Of this amount, $422,301.08 (24%) has been paid to M/WBE sub-consultants to date.
FISCAL NOTE: No significant Fiscal Operating impact is anticipated as a result of this project.
