ORDINANCE consenting to the addition of 29.9813 acres of land to HARRIS COUNTY WATER CONTROL and IMPROVEMENT DISTRICT NO. 157, for inclusion in its district

Background:

SUBJECT: Petition for the City’s consent to the addition of three (3) tracts of land totaling 29.9813 acres to Harris County Water Control and Improvement District No. 157 (Key Map No. 366 S, T).

 

RECOMMENDATION: Petition for the City’s consent to the addition of three tracts of land totaling 29.9813 acres to Harris County Water Control and Improvement District No. 157 be approved.

 

SPECIFIC EXPLANATION: Harris County Water Control and Improvement District No. 157 was created through the TCEQ in 2005 for the purposes of providing stormwater drainage and recreational facilities. The district currently consists of 3,279.16 acres within Harris County and is within the extraterritorial jurisdiction of the City. This district shares a boundary north of Bridgeland Creek Parkway with Harris County Water Control and Improvement District No. 159 that cuts through existing single family residential lots, and other parcels.  In order to shift the shared boundary of the districts to follow major roadways, the district has petitioned the City for consent to add 29.39 acres (15.20 and 14.19 acres) of vacant land, proposed as single family and commercial development, and 0.5913 acres of developed land (Foundry Church), for a total of three tracts totaling 29.9813 acres, to the district. The proposed annexation tract is located in the vicinity of House Hahl Road, Grand Parkway, Cypress Creek, and Fry Road. The addition of land to the district will not release it from the City’s extraterritorial jurisdiction.

 

The Utility District Review Committee has evaluated the application with respect to wastewater collection and treatment, potable water distribution, storm water conveyance, and other public services.

 

The proposed annexation tracts will be served by Harris County Municipal Utility District No. 489 which is provided with wastewater collection and treatment by the Harris County Municipal Utility District No. 418 Regional Wastewater Treatment Plant.  This regional plant also provides wastewater treatment to Harris County Municipal Utility District No. 418 and Harris County Municipal Utility District No. 419.  Potable water will be provided by Harris County Municipal District No. 489.

 

The nearest major drainage facility for Harris County Water Control and Improvement District No. 157 is Cypress Creek, which flows into Spring Creek, then to the San Jacinto River, and finally into Lake Houston. The proposed annexation tracts are not within the 100 year floodplain. A portion of the proposed annexation tract 1B (15.20 acres) is partially within the 500 year floodplain (20%).   

 

By executing the Petition for Consent, the district has acknowledged that all plans for the construction of water conveyance, wastewater collection, and storm water collection systems within the district must be approved by the City of Houston prior to their construction.

 

The Utility District Review Committee recommends that the subject petition be approved.
