SUBJECT: First Amendment to the Contract for Financing, Construction and Operation of Regional Wastewater Treatment Facilities between Chelford City Municipal Utility District and the City of Houston.
RECOMMENDATION: (SUMMARY)
Adopt an ordinance approving the First Amendment First Amendment to the Contract for Financing, Construction and Operation of Regional Wastewater Treatment Facilities between Chelford City Municipal Utility District and the City of Houston.

PROJECT HISTORY AND SCOPE:
On May 9, 1978, Chelford City Municipal Utility District (the “District”) and Harris County Municipal Utility District No. 98 (“MUD 98”) entered into a 40-year Contract for Financing, Construction and Operation of Regional Wastewater Treatment Facilities (the “Contract”). On or about December 30, 1986, the City annexed MUD No. 98 and thereafter assumed the powers, duties, assets, and obligations of the District pursuant to Chapter 43 of the Local Government Code. Under the Contract, the City sends wastewater flow from its service area to the District’s wastewater treatment plant for treatment.
The Contract is set to expire on May 8, 2018. The District and the City desire to enter into the First Amendment to extend the term of the Contract to August 12, 2021. This date was chosen based on the City’s plan to divert the wastewater flow from the District’s wastewater treatment plant to the City’s Upper Braes Wastewater Treatment Plant by August 2021.
FISCAL NOTE: No significant Fiscal Operating impact is anticipated as a result of this project.
