SUBJECT: Fourth Amendment to Professional Engineering Services Contract between the City and AECOM USA, Inc. dba AECOM USA Group, Inc. for services associated with Plant 3 Sedimentation Basin Baffle Walls Replacement, Transfer Pump Rehabilitation and Improvements, and Backwash Redundancy at Plants 1 and 2.
RECOMMENDATION: (SUMMARY) Approve Fourth Amendment to the Professional Engineering Services Contract with AECOM USA, Inc. dba AECOM USA Group, Inc., de-appropriate $539,260.12 from a terminated Professional Engineering Services Contract with Carollo Engineers, Inc. and appropriate $539,260.12 to the existing contract with AECOM USA Group, Inc.
PROJECT NOTICE/JUSTIFICATION: This project is part of the City's Capital Improvement Program to improve operability, maintainability and reliability for the East Water Purification Plant to comply with the Texas Commission on Environmental Quality and Surface Water Treatment Rule mandated by the United States Environmental Protection Agency. This program is required to meet existing and future water demand requirements.
DESCRIPTION/SCOPE: This project consists of providing professional engineering and related services associated with design of Sedimentation Basin Baffle Walls Replacement, Transfer Pump Check Valve Replacement, Transfer Pump Flow Monitoring, Transfer Pump Specific Energy Implementation at plant 3 and Backwash Redundancy at Plants 1 and 2.
LOCATION: The project is located at 2300 Federal Road, in Key Map Grid 496 U.
PREVIOUS HISTORY AND SCOPE: City Council approved the original Contract on December 16, 2009 under Ordinance Number 2009-1334. The scope of services under the Original Contract consisted of facility evaluations, design, and implementation of improvements to the East Water Purification Plant. Under this contract the consultant has accomplished the design rehabilitation of Storm Water and High Service Pumping Stations, flocculators, clarifiers and thickeners. Subsequent amendments were approved under Ordinance No. 2012-0015 on January 4, 2012, Ordinance No. 2014-0585 on June 11, 2014 and Ordinance No. 2016-0241 on March 30, 2016 for the design rehabilitations and improvements of sedimentation basin drives, flocculators, bar screens, variable frequency drives, scum removal systems, backwash pumping station, fire loop, drain valves and clarifier drives at plants Nos. 1, 2 and 3.
City Council also awarded a Contract to Carollo Engineers, Inc. approved on June 11, 2014 under Ordinance No. 2014-0586 to provide professional engineering and related services associated with the East Water Purification Plant design and improvements. After completing Preliminary Engineering, Carollo Engineers, Inc. requested for contract termination. The City of Houston has terminated the contract for Convenience in accordance with Article 14.2 of Document 00700 – General Conditions. Houston Public Works recommends assigning the remaining scopes in Phases II and III to AECOM USA, Inc. dba AECOM USA Group, Inc. who has a similar project under design at East Water Purification Plant.
SCOPE OF THIS AMENDMENT AND FEE: Under the scope of the Fourth Amendment, the Consultant will accomplish the following: provide phase II - final design and phase III - construction phase and additional services. A fee of $395,950.00 is budgeted for Basic Services and $143,310.12 for Additional Services. The Additional Services are anticipated to include geotechnical investigations, SCADA Programming and Check Valve testing.
The total requested de-appropriation amount is $539,260.12 to be appropriated to AECOM USA, Inc. dba AECOM USA Group, Inc. for Contract Services.
PAY OR PLAY PROGRAM: The proposed contract requires compliance with the City’s ‘Pay or Play’ ordinance regarding health benefits for employees of City contractors. In this case, the Contractor provides health benefits to eligible employees in compliance with City policy.
M/WBE PARTICIPATION: The M/WBE goal established for this project is 24%. The original Contract amount and subsequent appropriations totals $4,188,280.80. The Consultant has been paid $3,620,556.70 (86.44%) to date. Of this amount, $793,233.81 (21.91%) has been paid to M/WBE sub-consultants to date. Assuming approval of the requested appropriation, the contract amount will increase to $4,727,540.92. The Consultant proposes the following plan to meet the M/WBE goal.
