The Houston Parks and Recreation Department (HPARD) requests City Council approve the first Amendment to the Interlocal Agreement for Operation and Maintenance of Alabonson Park.
Alabonson Park is a City of Houston owned, 50.21-acre park located at 9650 N. Rosslyn.
On September 7, 2016 City Council approved an Interlocal Agreement (ILA) between the City of Houston and Harris County for Operation and Maintenance of the Park. Commissioners Court approved the ILA on August 23, 2016.
On March 23, 2017, the Texas Parks and Wildlife Department (TPWD) Commission approved the County's grant proposal for development of the park. TPWD requires, as a condition of the grant award, that the City agree to assume the County's post-completion obligations under the grant if the ILA is terminated and the County no longer has authority to operate or maintain the Park.
The proposed amendment to the interlocal agreement adds Section 6.10, Assumption of Grant Obligations as follows:
6.10 Assumption of Grant Obligation. In the event the Agreement is terminated after the county has completed the Project activities under the TPWD Grant, the City agrees to assume the Grant's post-completion obligations, as described in the Grant Agreement between TPWD and the County and the "Local Park Grant Program: Retention, Operation & Maintenance Responsibilities."
HPARD recommends City Council approve the amendment as it is consistent with Section 3.03 of the original agreement. All other terms and conditions in the original ILA remain unchanged.
Judge Ed Emmett approved the amendment on August 23, 2016.
