Summary:

ORDINANCE annexing to the City of Houston, Texas for limited purposes a certain area located within HARRIS-FORT BEND COUNTIES MUNICIPAL UTILITY DISTRICT NO. 5 and certain territory located in the vicinity of Harris-Fort Bend Counties Municipal Utility District No. 5 (the “District”), in Fort Bend County, Texas; containing findings and other provisions relating to the foregoing subject; adopting a regulatory plan for certain areas in the vicinity of the District; imposing the sales and use tax of the City of Houston in the area within the District annexed for limited purposes; assigning annexed areas to adjacent district from which district council member is elected until such time as district boundaries may be changed pursuant to the City of Houston Charter; providing for severability

Background:

The Planning and Development Department has negotiated Strategic Partnership Agreements (SPA) between the City of Houston and the utility districts listed below.

 

In each of these districts, the City is annexing for limited purposes only commercial property or undeveloped land. There are no residents in these territories. Upon annexation, the City will levy a one percent sales tax and all taxes collected in the areas will be divided evenly between the City and the district.  Upon the completion of the term of the SPA, the City has the option to annex the district for full purposes. 

 

In areas where there is out-of-district territory being annexed, the City is required to provide a service. For all of the proposed SPAs, there is territory outside the MUD to be included in the annexation. The City will enforce Chapter 6, Article 1 Section 6.3 of the Houston Texas Code of Ordinances regarding the running at large of domestic animals in this area.

 

All agreements require public notice and two public hearings which were held on November 1, 2017 and November 8, 2017.

 

For the following districts, the City will execute a new SPA:

 

  • Cypress Creek Utility District
  • Harris County Improvement District No. 17
  • Harris County MUD No. 525

 

For the following districts, the City will amend an existing SPA by adding new territory:

 

  • Harris County MUD No. 191 (Amendment 4)
  • Harris County MUD No. 278 (Amendment 1)
  • Harris Ft. Bend Counties MUD No. 5 (Amendment 2)

 

Council District assignments of the newly annexed areas are detailed on the accompanying SPA Precinct memorandum. 

 

The Planning and Development Department recommends the approval of the new and the amended SPAs.
