ORDINANCE finding and determining that public convenience and necessity no longer require the continued use of an East Richey Road 60-foot-wide stub portion to its terminus, located within the Northwood Subdivision out of the J.L. Runnels Survey, A-979, the Wilson Jones Survey, A-1542, the Richard West Survey, A-860, the W.C.R.R. Co. Survey, A-927, and the Barber Survey, A-125; vacating and abandoning the easement to RICHEY FM 1960 INDUSTRIAL, LLC, the abutting owner, in consideration of its payment to the City of $15,908.00, and other consideration - DISTRICT B - DAVIS

Background:

SUBJECT:  Ordinance authorizing the abandonment and sale of East Richey Road 60 foot-wide stub portion to its terminus, located in Northwood Subdivision, out of the J.L. Runnels Survey, A-979, the Wilson Jones Survey, A-1542, the Richard West Survey, A-860, the W.C.R.R. Co. Survey, A-927, and the Barber Survey, A-125.  Parcel SY17-033

RECOMMENDATION:  (Summary) It is recommended City Council approve an ordinance authorizing the abandonment and sale of East Richey Road 60 foot-wide stub portion to its terminus, located in Northwood Subdivision, out of the J.L. Runnels Survey, A-979, the Wilson Jones Survey, A-1542, the Richard West Survey, A-860, the W.C.R.R. Co. Survey, A-927, and the Barber Survey, A-125, in exchange for a consideration of $15,908.00.  Parcel SY17-033

SPECIFIC EXPLANATION:  Kathy Savell, The Pinnell Group, LLC, 26730 Interstate 45 North, Spring, Texas, 77386 on behalf of, Richey FM 1960 Industrial, LLC, (Frank Fulco Managing Member), requested the abandonment and sale of East Richey Road 60 foot-wide stub portion to its terminus, located in Northwood Subdivision, out of the J.L. Runnels Survey, A-979, the Wilson Jones Survey, A-1542, the Richard West Survey, A-860, the W.C.R.R. Co. Survey, A-927, and the Barber Survey, A-125.  Richey FM 1960 Industrial, LLC plans to incorporate the abandonment area into its property and re-plat the property for commercial use.  The Joint Referral Committee reviewed and approved this request.

Richey FM 1960 Industrial; LLC, has complied with the transaction requirements, has accepted the City’s offer, and has rendered payment in full.

Therefore, it is recommended City Council approve an Ordinance authorizing the abandonment and sale of East Richey Road 60 foot-wide stub portion to its terminus, located in Northwood Subdivision, out of the J.L. Runnels Survey, A-979, the Wilson Jones Survey, A-1542, the Richard West Survey, A-860, the W.C.R.R. Co. Survey, A-927, and the Barber Survey, A-125.
