ORDINANCE appropriating $200,000.00 out of Airport System FAA Grant Fund and $50,000.00 out of Airport System Improvement Fund authorizing the purchase of avigation easements or sales assurance/transaction assistance for a Noise Compatibility Program in the North Hollow Subdivision for George Bush Intercontinental Airport/Houston (Project No. 676) - DISTRICT B - DAVIS

Background:
RECOMMENDATION:
Enact an Ordinance appropriating $200,000.00 from the Airport System FAA Grant Fund and $50,000.00 from the Airport System Improvement Fund and approving the purchase of Avigation Easements or Sales Assurance/Transaction Assistance for homeowners that decline participation in the Sound Insulation alternative in connection with the North Hollow Residential Noise Mitigation Program on certain tracts of land in the vicinity of George Bush Intercontinental Airport/Houston. Project No. 676 (CIP A-0587.03; WBS Nos. A-000587-0007-4-01-01 and A-000587-0008-4-01-01)

SPECIFIC EXPLANATION:
After conducting an evaluation of the surrounding noise environment, the Houston Airport System (HAS) submitted the proposed George Bush Intercontinental Airport Residential Sound Insulation Program (IAH RSIP) to the Federal Aviation Administration (FAA). The IAH RSIP identified significant changes in noise levels east of Runway 9/27 (primarily in the North Hollow Subdivision area) and recommended a noise mitigation program for residents within affected area. This impacted area is made up of approximately 183 single family homes and is located east of HWY 59. The estimated population in the impacted area is 550 persons based on current U.S. Census Bureau data. The FAA reviewed and approved the IAH RSIP, and the primary responsibility for implementation of the IAH RSIP resides with HAS.

City Council previously approved the implementation of Phase 1 of the residential noise mitigation program. It is now requested that City Council approve funding for the acquisition of Avigation Easements over certain residential dwellings and for Sales Assurance/Transaction Assistance for homes within the North Hollow Subdivision that are exposed to increased noise levels adjacent to the subject area. For this Phase, approximately 30 homes are eligible for Avigation Easement payments or Sales Assurance/Transaction Assistance.

An Avigation Easement is a conveyance of airspace over another property for use by the airport. FAA Advisory Circular 150/5100-17 Change 7 states that where it is determined that fee title is not necessary, an Avigation Easement may be used to secure airspace for airport and runway approach protection and for noise compatibility programs. HAS will pay $5,000.00 per easement, which is an amount approved by the FAA for the Sound Insulation Program. The easements will be purchased from homeowners who elect not to participate in the noise mitigation program or who are not eligible for program benefits.

The Sales Assurance and Transaction Assistance options provide supplemental payments to homeowners to assist with the sale of their homes. Potential buyers must be apprised of the noise situation, the requirement to execute an avigation easement, and the opportunity to participate in the RSIP. The estimated payment to homeowners choosing the Sales Assurance or Transaction Assistance option is approximately $8,500.

PROJECT COSTS:
$250,000.00 total - Avigation Easements/Sales Assurance/Transaction Assistance

FAA AIP GRANT PROGRAM:
This project is eligible for the FAA AID Discretionary Noise Grant (FAA Noise Grant 3-48-0111-100-13) whereby HAS will be responsible for 20% of the costs, which are fully recoverable from airline rates and charges, and the FAA will cover 80% of the costs.

Fiscal Note:
This item is considered to be a capital project. The project is for the acquisition of Avigation Easements or Sales Assurance/Transaction Assistance over certain residential dwellings.

There is no impact to the FY18 Adopted Operating Budget for this item. Therefore, no fiscal note is required as stated in the Financial Policy Ord. 2014-1078 as an Operating Budget Item.
