RECOMMENDATION: (Summary) It is recommended City Council approve an ordinance authorizing the abandonment and sale of: 1) a 10-foot-wide prescriptive water line easement; 2) a 10 foot by 10 foot prescriptive fire hydrant easement; and 3) three 10 foot by 10 foot prescriptive water meter easements, all being out of Unrestricted Reserve “A”, Block 1, of the Energy Gateway Addition, out of the George Bellows Survey, A-3, in exchange for a consideration of $235,193.00. SPECIFIC EXPLANATION:
Lipex Properties, L.P., (MetroNational Corporation [Jason Johnson, President], General Partner), the fee property owner, requested the abandonment and sale of: 1) a 10-foot-wide prescriptive water line easement; 2) a 10 foot by 10 foot prescriptive fire hydrant easement; and 3) three 10 foot by 10 foot prescriptive water meter easements, all being out of Unrestricted Reserve “A”, Block 1, of the Energy Gateway Addition, out of the George Bellows Survey, A-3. The applicant constructed an office building and parking garage on the site. The property was being developed at the time of the appraisal.
Lipex Properties, L.P. has complied with the transaction requirements, has accepted the City's offer, and has rendered payment in full.
