Settlement approval is requested for this matter, which involves an automobile accident that occurred on November 8, 2011, at the intersection of Rosehaven and Chimira. Chimira Street normally has stop signs on the east and west of the intersection, but the sign for the eastbound traffic was missing. Frederick Tippett-Crenshaw, another defendant, was travelling east on Chimira and collided with vehicle driven by Cruise, the plaintiff, allegedly due to the missing stop sign.
Cruise was taken by ambulance and treated for neck pain. Cruise underwent cervical spine decompression surgery as well as another surgery which was allegedly unsuccessful. Cruise’s physician is recommending an additional surgery to reduce her pain. Her medical bills in the past exceeded $137,500.00. Tippett-Crenshaw settled separately with Cruise. The total settlement requested to be approved is $137,500.00.
Funding for this item is included in the FY 2017 Adopted Budget. Therefore, no Fiscal Note is required as stated in the Financial Policy Ord. 2014-1078.
