An ordinance approving and authorizing the execution of a Compromise, Settlement, Release and Indemnification Agreement between Jonathan Zuniga Wong and the City of Houston to settle Cause No. 2021-13830; Jonathan Zuniga Wong v. City of Houston, Texas; in the 11th Judicial District Court of Harris County, Texas
Brief Description:
On March 7, 2020, at approximately 10:24 am, Plaintiff Jonathan Zuniga Wong (DOB: 04-02-86; Hispanic male) was sitting inside his 1998 yellow Chevrolet Astro van parked near the curb facing west in the 9000 block of Petersham. Jennifer Mavas Lewis (DOB: 03-26-1977; African American female), a former City of Houston employee who was with Solid Waste Management Department, was driving a 2020 blue Freightliner M2 rear loader and was traveling westbound in the 9000 block of Petersham servicing yard waste. Due to a parked car, Ms. Lewis drove past a bag at 9019 Petersham Street. To retrieve the missed bag, Ms. Lewis backed up with the assistance of her spotter, Donte Handy, who was on the ground near the passenger side of her vehicle. Ms. Lewis became distracted while backing up to pick up the missed bag and drifted to the northside of the street where Plaintiff Zuniga Wong’s 1998 yellow Chevrolet Astro van was parked. Mr. Handy yelled at Ms. Lewis to stop, but Ms. Lewis did not hear him. Ms. Lewis’s driver sidestep and lower tailgate hit Mr. Zuniga Wong’s lower tailgate near the rear on the driver’s side and pushed the van approx. 12 feet which caused front passenger front wheel to “jump” the curb before it came to a stop. Houston Police Deptartment investigator E. Rubio found Ms. Lewis at fault and issued her a citation for backing without safety resulting in accident.
Fiscal Note: Funding for this item is included in the FY2026 Adopted Budget. Therefore, no fiscal note is required as stated in the Financial Policies.
