SUBJECT: Accept Work for Miscellaneous Large Diameter Water Line Improvements - Package 1.
RECOMMENDATION: (SUMMARY) Pass a motion to approve the final contract amount of $7,880,343.66 or 4.63% over the revised contract amount, accept the Work and authorize final payment.
PROJECT NOTICE/JUSTIFICATION: This project was part of the City's Surface Water Transmission program and was required to maintain, improve and replace existing large diameter water lines and to meet Harris-Galveston Coastal Subsidence District's Legislative mandate to regulate the withdrawal of groundwater.
DESCRIPTION/SCOPE: This project consisted of the construction and rehabilitation of large diameter water transmission lines from 24-inch to 84-inch by combination of open cut, tunneling, sliplining and rehabilitation construction methods, including valves, connections and appurtenances at seven different sites throughout the City. Lockwood, Andrews & Newnam, Inc and Nathelyne A. Kennedy & Associates designed the project with 1050 calendar days allowed for construction. The project was awarded to Harper Brothers Construction, LLC with an original contract amount of $7,192,912.00 and an additional appropriation of $339,028.87 for a revised total contract amount of $7,531,940.87.

CONTRACT COMPLETION AND COST: The contractor, Harper Brothers Construction, LLC, has completed the work under the subject contract. The project was completed beyond the established completion date with an additional 1254 days approved by Change Order Nos. 5, 6, 7, 8, 10, 11, 12, 13, and 15. The final cost of the project, including overrun and underrun of estimated unit price quantities and previously approved Change Order Nos. 1, 2, 3, 4, 5, 6, 7, 9, 10, 11, 12, 13, and 14 is $7,880,343.66, an increase of $348,402.79 or 4.63% over the revised contract amount. The increased cost is a result of the difference between planned and measured quantities.
M/WSBE PARTICIPATION: The advertised M/WBE goals for this project were 12.00% MBE and 7.00% WBE. The approved M/W/SBE goals were 8.63% MBE, 7.00% WBE, and 3.37% SBE. According to the Office of Business Opportunity, the actual participation achieved was 3.10% MBE, 0.00% WBE, and 1.75% SBE. Although the Prime did not meet the approved participation goals, they provided sufficient documentation outlining the challenges posed by scope changes, emergency site conditions, and the reassignment of work. The Prime maintained open communication with OBO and demonstrated documented outreach to certified firms, which supports their efforts to comply with the City’s Good Faith Efforts requirements. Based on these documented actions and context, the MWSBE performance on this project is rated Satisfactory due to Good Faith Efforts.
