Summary:

ORDINANCE appropriating $3,450,000.00 out of Dedicated Drainage and Street Renewal Capital Fund - Drainage Charge; awarding contract to C&A CONSTRUCTION, LLC for FY 2025 Local Drainage Program (LDP) Contract #2; setting a deadline for the bidder’s execution of the contract and delivery of all bonds, insurance, and other required contract documents to the City; holding the bidder in default if it fails to meet the deadlines; providing funding for CIP Cost Recovery, contingency, testing services relating to construction of facilities financed by the Dedicated Drainage and Street Renewal Capital Fund - Drainage Charge

Background:

SUBJECT: Contract Award for FY2025 Local Drainage Program (LDP) Contract #2. 
 
RECOMMENDATION: (SUMMARY) Award a Construction Contract to C&A Construction, LLC for FY2025 Local Drainage Program (LDP) Contract #2 and appropriate funds. 
 
PROJECT NOTICE/JUSTIFICATION: This project is part of the Transportation and Drainage Operations Program and is required to provide work authorization on a location by location as-needed basis, to preserve, repair, rehabilitate or reconstruct the storm-water drainage asset including street rehabilitation to a condition that it may be effectively used for its designated functional purpose.
 
DESCRIPTION/SCOPE: This project consists of the Citywide program that provides construction services to resolve localized storm water drainage problems and rehabilitate the street to further improve the drainage. The scope is established by each work authorization. The Contract duration for this project is 730 calendar days.
 
LOCATION: The projects are located throughout the City of Houston. 
 
BIDS: This project was advertised for bidding on November 15, 2024. Bids were received on December 5, 2024.  The five (5) bids are as follows:

AWARD: It is recommended that this construction contract be awarded to C&A Construction LLC with a low bid of $3,000,000.00 (0.715 Adjustment Factor). 

PROJECT COST: The total cost of this project is $3,450,000.00 to be appropriated as follows:

Testing Services will be provided by Professional Service Industries, Inc. under a previously approved contract. 
  
HIRE HOUSTON FIRST: The proposed contract requires compliance with the City’s ‘Hire Houston First’ (HHF) ordinance that promotes economic opportunity for Houston business and supports job creation. In this case, C&A Construction, LLC is a designated HHF company, but they were the successful awardee without application of the HHF preference. 

PAY OR PLAY PROGRAM: The proposed contract requires compliance with the City’s ‘Pay or Play’ ordinance regarding health benefits for employees of City contractors. In this case, the Contractor  provides benefits for some employees but will pay into the Contractor Responsibility Fund for others, in compliance with City policy.
 
M/WSBE PARTICIPATION: The contractor has submitted the following proposed program to satisfy the 13.00% MBE goal and 7.00% WBE goal for this project.
