SUBJECT: Amendment to the Professional Engineering Services Contract between the City and Consor Engineers, LLC, formerly AIA Engineers, LTD for Neighborhood Street Reconstruction (NSR) Project 454.
RECOMMENDATION: Approve the Amendment to the Professional Engineering Services Contract with Consor Engineers, LLC, formerly AIA Engineers, LTD and appropriate funds.
PROJECT NOTICE/JUSTIFICATION: This project will replace existing residential streets that have been deteriorated beyond economical repair and normal maintenance and improve drainage.
DESCRIPTION/SCOPE: Project provides design of the storm drainage including roadway concrete paving, curbs, sidewalks, driveways, street lighting and necessary underground utilities. This project has been identified as Subproject One under NSR Project 454.

PREVIOUS HISTORY AND SCOPE: City Council approved the original contract on May 1, 2013 under Ordinance No. 2013-0371. The scope of services under the original contract consisted of Phase I – preliminary design, Phase II – final design, and Phase III – construction phase services and additional services. Under this contract, the Consultant has accomplished Phase I – preliminary design, and 65 % Phase II – final design. The below subsequent Council Actions associated with this contract include:

SCOPE OF THIS AMENDMENT AND FEE: Under the scope of this amendment, the contract will be updated to incorporate the latest version of Exhibit C - Raw Salaries. A fee of $754,062.00 is budgeted for Basic Services and $346,298.22 for Additional Services.
The total requested appropriation is $1,155,378.22 to be appropriated as follows: $1,100,360.22 for contract services and $55,018.00 for CIP Cost Recovery.
PAY OR PLAY PROGRAM: The proposed contract requires compliance with the City’s ‘Pay or Play’ ordinance regarding health benefits for employees of City Contractors. In this case, the Contractor provides health benefits to eligible employees in compliance with City policy.
M/WBE PARTICIPATION: The M/WBE goal established for this project is 24.00%. The original contract amount and subsequent appropriations total $1,664,518.71. The Consultant has been paid $1,664,500.00 (100.00%). Of this amount, $360,829.00 (21.68%) has been paid to M/WBE sub-contractors to date. Assuming approval of the requested additional appropriation, the contract amount will increase to $2,764,878.93. The Consultant proposes the following plan to meet the M/WBE goal.
