Summary:

ORDINANCE appropriating $1,938,410.00 out of Water & Sewer System Consolidated Construction Fund for installation of a Main Canal Radial Gate Bypass supplying raw water to the City of Houston under contract awarded by Coastal Water Authority to BRH GARVER CONSTRUCTION, L.P. pursuant to an operating contract with the Coastal Water Authority (as approved by Ordinance No. 1995-676)

Background:

SUBJECT:  Contract Award for Installation of Main Canal Radial Gate Bypass supplying raw water to the City of Houston and operated by the Coastal Water Authority. WBS: S-000019-0094-7.

 

RECOMMENDATION:  (Summary)  Accept low bid, award construction contract, and appropriate funds.

 

PROJECT NOTICE/JUSTIFICATION:  The Coastal Water Authority (CWA) operates the raw surface water transportation system for the City of Houston (City) and provides conveyance for many governmental and industrial users.  The radial gate structure located at CWA’s Canal Maintenance Station controls the flow of water going downstream to the Lynchburg Reservoir and also maintains adequate water surface levels to supply the headwaters of the Cedar Point Lateral system that supplies industrial and agricultural customers.  Based on previous inspections, the radial gate is in need of repairs to extend its useful life, or may need to be replaced.  However, the radial gate cannot be taken out of service for inspection, repairs, or servicing due to downstream customers requiring uninterrupted water supply. 

 

The City and CWA are parties to an Operating Contract dated June 21, 1995 (Operating Contract), approved by City Ordinance 95-676.  The Operating Contract at Article II, Section 202 states, in part, that “the Public Works Director may request the Authority to …make major renovations or repairs of City Projects which will not be financed with the proceeds of bonds or other obligations of the Authority.  Upon such request, the Authority shall prepare for the City a proposal and a proposed budget for the Capital Project.  The Authority shall not commence implementation of any Capital Project until: (a) the proposal has been accepted by the Public Works Director; and (b) the City Council has approved the Capital Project and has appropriated sufficient moneys to fund the Capital Project.”

 

CWA obtained proposals from qualified contractors and recommends awarding the contract to the low bidder, BRH Garver Construction L.P., in the amount of $1,726,000.00.

 

This project was identified in the 2016 CWA budget submitted by the Department of Public Works and Engineering as part of the FY17 Department Budget that City Council approved in June 2016.  The Department is now requesting that City Council approve the project and appropriate funding for $1,938,410.00, so that CWA can commence the project.

 

DESCRIPTION/SCOPE:  A bypass gate structure has been proposed at the lateral canal extending to the Cedar Point area of southwest Chambers County that will allow the radial gate to be isolated for inspection and needed repairs or replacement.  The project includes furnishing labor, equipment, and materials to construct a 500 MGD canal bypass in the form of double barrel reinforced cast in place concrete box culverts, a reinforced concrete intake, and outlet structures.  The duration of this project is 270 calendar days from the issuance of a notice to proceed.

 

LOCATION:  The project area is located to the Southwest of SH146 along the CWA Maintenance Station Access Road in Dayton, TX. The project is located in Key Map Grid 422.

 

BIDS:

 

This project followed procurement practices consistent with CWA’s bid guidelines. Six (6) bids  were received  on July 22, 2016 for this project as follows:

AWARD: It is recommended that this construction contract be awarded to BRH-Garver Construction, L.P. with a bid of $1,726,000. 

 

PROJECT COST:

 

The total cost of the project is $1,938,410.00 to be appropriated as follows:

·        Contingency:                                                                                       $86,300.00

 

Construction Management Services will be provided Lockwood, Andrews & Newman under a previously approved contract.

 

HIRE HOUSTON FIRST:  The proposed contract is between CWA and BRH Garver Construction L.P., therefore, it does not require compliance with the City’s Hire Houston First program.

 

PAY OR PLAY PROGRAM:   The proposed contract is between CWA and the lowest bidder, therefore, it does not require compliance with the City’s Pay or Play ordinance regarding health benefits for employees of City contractors.
